French Court Guts 'Three Strikes' Law
Entertainment industry faces yet another setback...

According to the New York Times, France's Constitutional Council has all but gutted the country's new three strikes law, which would have forced ISPs to kick heavy P2P users from the Internet. The Council, which checks laws for adherence to French constitutional principles before passing them, found that the assumption of guilt and the termination of Internet connectivity violated French citizen rights. Consumer advocacy firm Public Knowledge issued a statement saying the ruling sends a "persuasive signal to media moguls around the world that this type of policy is unacceptable."

Good.....

Doesn't mean they'll stop trying. This defeat should be examined in Washington before anything this stupid is tryed.

Re: Good.....

Since when has U.S. lawmakers given a rats azz about foreign laws or rulings? I have heard several times over the past month from various Washingtonians that they are not "Citizens of the world".

Then why are we going to emulate their healthcare when we can't pay for it?
And why do we keep subsidizing these "citizens of the world"?

Ok first of all it's "tried". Second, why would they try something like this when the US isn't part of the EU?

I don't think we have the process where the constitutionality of something is questioned in the courts before it has the force of law.

It's sad it had to get to the top court in the land before common sense was applied to the law. Course that happens all the time here too....

Yeah, wouldn't want to rile up any honesty around here. Excuse me while I try to come up more ridiculous excuses so I don't feel as guilty about stealing.

one good turn

for every biased pirate bay decision.. there will be two or more "Viva la resistance" setbacks for the entertainment industry. As it is cable-tv content is marching it's way onto the internet tubes one torrent at a time. Comcast 250gb cap (and Time Warner's 40gb cap) be damned!

A FCC that makes sense?

Constitutional principles? You mean they actually have to adhere to constitutional principles. You can't just make up laws and change the wording in what you think the constitutional principles were trying to say with slick lawyers? Well then, I guess you learn something new everyday...

I think the "Three Strikes Law" has now got three strikes against it, but will it go away, doubtful.

Now that's a progressive FCC for the people, and one I can trust! Sorry just wanted to say that at least once in my life...
