Viacom overhauls copyright claim process after EFF pressure

Criticism has been mounting over the fact that YouTube & Google pull videos upon request without investigating the complaints, which doesn't give users a fighting chance in cases of parody or fair use. It was recently shown that even fake DMCA requests seem to get the job done. Their knee-jerk pulling of videos was again highlighted last weekend when they pulled presidential candidate John McCain singing about starting a war with Iran, only to repost it and admit error after significant public outcry (see video).

The EFF had filed a lawsuit against Viacom for trying to have parody Stephen Colbert videos cited above taken offline, but today dropped the lawsuit:
"Viacom initially denied sending the Digital Millennium Copyright Act (DMCA) takedown notice that resulted in the removal of the video from YouTube, while saying it had no objection to "Stop the Falsiness." However, Viacom later conceded it was the source of the demand and admitted error in taking action against the parody."
The company has since promised they'd expand their review process and set up a hotline for false takedown request complaints. That, of course, begs the question: Will Google/Youtube follow Viacom's lead?

Why should they care?

The megacorps exist to CONTROL the flow of information. If they can prevent people from seeing what they don't want them to see, then they win. If I were the megacorps, of course I would send a DMCA notice for EVERY video I owned, or every video that mentioned me or any of my megacorps susidiaries. Remember, control the news, and you control the populace. War is Peace, freedom is slavery, ignorance is strength. We should all be good little proles, and work for our masters, and spend money like our masters tell us to spend it.

Aside from the fact that what you said reminds me of the Pink Floyd song " The Wall "

Google sadly isn't doing very well in my book on this one, they should have a team setup to investigate the video requests to be taken down. It's a lot of videos but it should at the very least be done.

Of course if it were up to me I would fight it a lot more, in essence companies get riled up too easily over Youtube and other such sites / services. Companies basically get free advertising if you think about it, they don't have to pay to host the files. Quite a few people I know of that watch music videos, user made music videos and other such content tend to go out and buy the albums / movies / etc.

Companies should be happy, of course if they could see that anyways. Unfortunately they're so bent on controlling every piece of information that it won't happen.

Liability for Fake/Incorrect DMCA Notices

Shouldn't those who submit fake or invalid DMCA takedown demand notices be prosecuted?

I'm not against the idea, but I can't think of a single criminal charge that would stick. Google could of course sue them.

I would think in the case of a fake DMCA notice, that is, someone claiming to be a copyright owner but really isn't, who types up a notice and emails it to Google, would probably be liable for forgery and fraud charges at the very least. If the person is outside of CA (where Google is based), then Federal charges could also apply.

I guess it's like Patton and Bradley in WWII, Bradley said to Patton once "George, that's the difference between you and me, I hate war, you love it", consider me in the same mind as General Bradley.

confused

I thought that is how it is supposed to work.

They swear it is theirs..take it down.

You swear no it isn't...put it back.

If they still disagree all hell breaks loose at that point or some such. But no info on what happened at step 2 here. Did viacom still say it was theirs ? or was all the excitement over step 1? am i missing something?
