The story behind anti-consumer cell phone laws

It is no secret that telcos spend millions of dollars to lobby politicians in CA nor is it a secret that it works with Gov. Schwarzenegger. Most of the media coverage has been about the influence lobbyists have on cable bills in the state but this recent article takes a look at the influence that telcos with cell phone divisions have had on state legislation. Their influence is due in no small part to the amount of money they have funneled in to Schwarzenegger’s campaign.

“"It's a testament to the cell phone industry's power that the first thing Arnold Schwarzenegger did when he came into office was put people on the Public Utilities Commission who were pro-industry, anti-consumer, and immediately proceeded to tear down pro-consumer regulations that prevented cell phone company abuses," said longtime consumer advocate Harvey Rosenfield”

Those abuses include the difficulties and costs of getting out of cell phone contracts; (we know the lengths some go to to get out of their contracts). Specifically cited is the case of SB 831, a consumer-friendly measure proposed earlier this year by Sen. Alan Lowenthal. The legislation would have allowed for a 30-day contract cancellation policy as well as other means of making it easier to cancel contracts. It is reported that the bill had significant support but died, perhaps due to the $50,000 donated by AT&T to make that happen.

Arnold doesn't legislate laws; wrong target of ire

Guess what, the governor does not write the laws in California - the legislature does. And pro-industry(not anti-consumer) legislation like state wide franchising was passed in a bi-partisan manner by the legislature. And the $50,000 mentioned didn't go to Arnold but went to a committee supporting removing term caps on legislators.

Typically biased reporting

Although the underlying, linked stories make it clear that the DEMOCRAT controlled legislature was bought and paid for, the article finds a way to slam the REPUBLICAN Governor over old news about who is/was on the PUC.

Sheesh, we know you're biased, but couldn't you at least TRY to be a little less blatant about it?

Guess what, the governor does not write the laws in California - the legislature does.
But he does have to approve them... So, while he might not write them, he does have an important role in the legislative process and that can be called into question when his office's actions are looked at in light of the money he has received from lobbyists and campaign supporters.

The issue with Ahnold was more like the last bastion (given the veto power) in blocking Telcos from doing even more of "whatever the f we want".

It's clear most the Senate Democrats were bought out by the telcos long ago. The lack of consumer protection, and corporate adulation has long become tiresome.

They Bought Him?

Wonder why the telcos who own Schwarzenegger let him sign this law about teen drivers! Won't this law cost the telcos?

A law signed by Gov. Arnold Schwarzenegger on Thursday will require those teens to put down all cell phones and other electronic devices while driving. Older drivers will be able to use hands-free devices but minors won't enjoy that luxury — in part because of the popularity of text-messaging among teens.

Damn good law too. 16 year olds SUCK at driving. Who the hell wants testosterone laced idiots and gabby girls to be distracted when they lack the necessary driving experience to being with? It's no different than handing them a loaded gun with the safety off. They might know how to use it, but tell them its jammed, and half of them would look down the barrel. At that age, responsibility and common sense simply are lacking. Hence, for the safety of everyone else, their eyes need to be on the road and not focused on their conversation. Recently, they passed a law here that 16 yr olds can't have but more one other person in their car at a time. This includes a parent. Another great law that I support. You are a minor and you are being given a privilege. Driving is not a RIGHT. If you wish to keep this privilege, you must show you are trustworthy enough to earn the greater responsibility of having more folks in your car.

Too bad this law(ordnance)doesn't apply to under 21's as well. I live in a college town(San Luis Obispo), and it's been nuts around here with all the newbies that are starting school tomorrow(9/17) driving around while having a cell phone planted on one ear as if they are "The Borg". Was almost hit twice the past week while I was in a cross-walk by some dum-a@# not pay'in attention to driving-probably chatting with friends/parents how bitch'in it is to be here in S.L.O.
Can't wait till January '08-then you'll need a Bluetooth unit to use your phone. Although, it probably won't stop the 18-21 group from STILL driving like idiots...or any other age group, for that matter!!!

Very Very true. At least you'd hope the 18-21 group would have more experience, but apparently, there are still some dumb ones among them. In my personal assessment, the 16-18 year old group is the worst (High School). I think 19 year olds still fall here, because they are either still in High School or just becoming college freshman. Their experience with life and driving is still rather limited. However, I truly hate sharing the road with 16-18 year olds. Nothing beats seeing them speed, swerve, or be distracted. When you combine this with the inexperience behind the wheel, you got a dangerous situation. This is not to say that adults aren't bad drivers, too. I have seen MORE than plenty. It's just statistically speaking, the 16-19 age group is at the highest risk for accidents. Much of this behavior is attributed to immaturity and plain stupidity. I for one have nothing against setting restrictions on the. To bad these laws can't apply to 16-20 year olds. I believe at 21, you should finally acquire full privileges.

I completely see your point but would like to add that if they are "responsible" enough (they being a broad brush) to be placed in Iraq with a loaded weapon, driving a 10K pound vehicle then despite the risk I am willing to share the road with them. By no means do I disagree on a lot of your points just that I don't think restrictions such as those should be placed so quickly on that demographic group.

Being given a gun doesn't equate to responsibility in the least bit. In my opinion, thats a pretty far stretch on your comparison. Let's face it, very irresponsible people are given the right to do something simply by reaching an arbitrary number. While no number is going to fit everyone, there is a certain amount of life experience that is expected for one to be allowed participation in a certain activity (driving, drinking, smoking, movies, etc). By no means do those 18 year olds in Iraq have that. Merely, they are looking for an opportunity and I fully believe many do not know what they're getting themselves into. A big part of this is due to what I would call the "Superman Complex". Nothing is going to hurt them and they are invincible. Why do you think traffic accidents are so high for the 16-19 year old age group? They think they can drive as fast as they want, party as much as they want, and all will end well. Sadly, life is not like that. Yet, for people of this age range, that mentality and maturity to see that fact simply has not yet developed. Hence, to equate being able to shoot and die with responsibility is nothing I would state on my own. It's your opinion of course, but I beg to differ on it.

Even tho i am more of a democrat, i must agree with the poster above the above poster. I am really impressed and happy with the way Schwarzenegger has/is handled issues as governor.

He is a blessing for California, in my opinion.

Change the constitution to allow Schwarzenegger to run for president already. I'd vote for him in a GA minute , don't matter what party he is in, tho after getting in he should form his own party.

That would totally rule.

Arnold isn't a Republican, his policies show as much.

He certainly is much better than that abortion of a Governor "Gray" Davis.

Amtrak California, Amtrak, Metrolink, Caltrain, etc. are all doing VERY well and are booming, ole Arnie is blind to reality though, but then he is an actor. The High Speed Rail is going forward though, despite his efforts to stifle it.

I do admire him for one thing though, he stands up and even butts heads with gwbuh and darth cheney.

You somehow think that not having cell phones in cars will discourage teen cell phone use? LOL. Nearly every single one of them has their own line as such, even before they get driving. I highly doubt having teens STFU while driving will get them irate enough to can using phones entirely.

The strange thing is that the cell phone companies haven't been very vocal on these bans anywhere... Perhaps it is because they realize that having a live customer is much better than have a dead or paralyzed customer who can't use their phone service. Of course they might also see the bans as an opportunity to make more money selling Bluetooth hands free devices.

As for Kalifornia being the land of opportunity..
well, unfortunately for all the wrong reasons. Wholesale selling out the public in favor of large corporations can (and almost did) bankrupt the state as compared with NY. I wouldn't hold my breath if I were you for the likes of telco or cable co. for that matter to give customers anything NEAR proper broadband access-- the potential to screw the state's #1 public interest "HOLLYWOOD" just ain't having it..

If the internet were responsible for screwing Wall Street moguls out of tons of money, they'd shut it down here too. But unfortunately NY knows (unfortunately the hard way) not to put that many eggs in one basket for it's economy.
