ISPs Ignore Minnesota Gambling Ban Order
Content filter push not going particularly well....
by Karl Bode Tuesday 26-May-2009 tags: business · content
If you remember, at the tail end of April, Minnesota regulator John Willems thought it would be a good idea to demand broadband ISPs who do business in Minnesota ban access to all gambling websites. Unfortunately for Mr. Willems, he apparently didn't have a very solid grasp of either technology or law. Not only would Minnesota consumers quickly find a way around the filters, but Willems is trying to force carriers to adhere to "common carrier" regulations that don't apply to modern broadband ISPs (or the offshore gambling outfits). Of the eleven ISPs who were sent letters by Willems demanding they start filtering gambling websites not one of them has responded, which tells you how seriously they're taking the request.

Good

Perhaps someone should remind Commissar Willems of what the 9th amendment means.

What a scumbag.

The amendments were not meant for the states. The 13 states/colonies had the amendments written to limit the power of the new union, not the power of the states.

One small item that most people tend to forget about now-a-days.

Of course, the rulers of the states that original formed the union would probably be shocked at how much power the states have given over to the feds (in part due to people wanting a hand out at no APPARENT cost).

One of the Reconstruction Amendments changed that. Essentially, whatever is prohibited to the Federal Government is also prohibited to the state governments.

Re: Good

The 14th Amendment has to be applied (incorporation doctrine) to the states specifically by a Supreme Court ruling, I believe. It doesn't automatically happen. For instance, many amendments have been incorporated for a long time, but the 2nd was only recently incorporated with the recent Heller decision.

Just Wait!

How long will it be before King John sends out a bus load of police to break down the door of one of the ISP's and rip out their equipment. That will send a warning to the other ISP's. Maybe John should change his name to Joe McCarthy, another demagogue!

Remember King George told all Government Officials that they are above the Constitution. Sorry what Constitution?

That will work. You issue an injunction, if they don't comply you have the town judge order the sheriff to go and enforce, and arrest the whole Central Office/Datacenter/Headend if they don't comply, or issue exponentially increasing fines until you can confiscate equipment (bank accounts out of jurisdiction) to pay for the fines.

How many people were "blacklisted" by Sen. Joe McCarthy? While he was a demagogue, he was a relatively harmless one. He had no connection with the damaging "House Committee on Un-American Activities" (often incorrectly "acronymed" as, "HUAC").

Re: Just Wait!

NormanS: You might want to check these links. Joe McCarthy was anything but harmless. He ruined the careers of many Americans. Check out these links:

»en.wikipedia.org/wiki/Joseph_McCarthy

If you have a chance, watch the movie: Good Night and Good Luck. It reveals how Edward R. Murrow ended Joe's tyranny.

Re: Just Wait!

Please re-read my comments. Sen. Joe McCarthy was a Senator, not a Representative. He had zip-all to do with the HCUA (your first link). That was damaging, yes. But not his baby.

The list he gave in his "Wheeling" speech (your second link) was not a black list, per se. He gave speeches (demagogue). His worst acts were investigations of VoA and IIA. He had nothing to do with what the HCUA did, or what happened in Hollywood.

Re: full of it...

Yeah I'm quite sure that blocking their state lottery websites would just piss them off more.

These jackasses tell people to block stuff, but don't take any personal responsibility in the process. It's also quite a bit of work to keep up on the blocking, so where are their funds for them to support this extra labor for something which is bs?

Clearly there's some insanity going on in the state government.

In an effort at reaching a workable compromise, broadband ISPs who do business in Minnesota have banned access to all letters from state regulators.
