'Jailbreaking' Exemption to DMCA Expires Soon
EFF Pushes to Ensure Jailbreaking Remains Legal
by Karl Bode Thursday 26-Jan-2012 tags: legal · hardware · software · content · networking · consumers
Tipped by drew See Profile
As it stands, the often empowering act of jailbreaking your device remains perfectly legal thanks to an exemption embedded in the DMCA. In July of 2010 the government created an exemption, ruling that such tinkering perfectly legal as long as the intent wasn't to bypass copy protection. With the exemption set to expire, user drew See Profile writes in to note the Electronic Freedom Foundation is waging a campaign to convince the U.S. Copyright Office to extend the exemption and expand it to ensure it covers tablets. The USCO is fielding comments via this link until February 10 at 5 PM Eastern Time. If you actually like having full control over the devices you pay hundreds of dollars for, it might be worth making your voices heard.

If jailbreaking is illegal, then we own nothing.

Re: Crazy

Big deal, do you really think somebody is going to knock you door down because you jailbroke your phone or tablet.

They are trying to prevent us from unlocking our phones in Canada, under the guise of copyright.

Re: Crazy

Its not the end user they are aiming for , its the people who develop it.

If this is your issue in the True North then maybe it is time to stand up and do something about it ?

The us revolution is about to begin , grab your pop corn, the corporations have for to long had major control. This stuff is about to change and I hope for it to help elevate us above the rest.

id imagine if SOPA gets rebooted and passed we will simply see the likes of Apple and the wireless carriers in general push to get jailbreaking/rooting sites locked off from US connections.

Yes. Especially if it is under the guise of copyright enforcement.

Apple? Remember this is the company that sent a SWAT team to recover a leaked phone.

They are trying to prevent us from unlocking our phones in Canada, under the guise of copyright.

No, they are control freaks, period. Anything that doesn't fit within the Apple business model must be crushed at all costs. They want to lock you into iTunes and make sure that they get that 30% cut of all app sales.

I am currently in a quandry over jailbreaking my 4S. I would love to play around with some of the apps in Cydia that allow the phone to do things it should do. However, I am also covered by an AppleCare+ policy and the thought of voiding that policy and kissing $99 goodbye bothers me. I figure I am probably better off waiting until the coverage expires in 2013 and then playing with it. Of course I will probably be looking at an iPhone 4GS/5/6 or whatever they are calling it then.

Not to mention a jailbroken phone is also more exposed to malware infiltration from non-Apple store apps.

:

So it's simple then.
If you can't handle the risk you don't jailbreak.

The last thing on my mind after jailbreaking is malware. I wouldn't use a PC if i was.

But their wallet isn't more exposed if they want to tether.

Not if you're careful. I have only a couple of VERY well-known apps from Cydia on mine.

I really don't care, it's not like there won't be Jailbreaks even if the explicit exemption runs out. I have a constitutional right to Jailbreak, and I will exercise it no matter what Apple wants.

I love Springtomize and SBSettings for the iPhone. My iPad runs dreamboard with HoneyPad Pro theme. Looks like a Honeycomb tablet but with the entire apple app store at my fingertips.

Just watch out as there's some apps that detect jailbreak and refuse to run. DirecTV, Time Warner, Cablevision, Skype, Good for Enterprise and a few others. Surprisingly HBOGo and Netflix still work so who knows what stick is up the other companies ass.

Well, screw those companies' apps then. Just don't use them. I didn't realize that Skype was that nasty about it. Guess I won't be using Skype on the iPhone...

Legally you are protected. They can't void your warranty for a service they don't provide for free. They can't void your warranty because you didn't get your apps from the Apple Apps Store. And worst case, oops I ran over the iPhone with my 4x4.

If you want to wait it out, simply download a copy of the jailbreaking tool and keep your iOS current at 5.0.1 and do not update it to any later version. Once your coverage expires, jailbreak then.

I also heard that you can always remove the jailbreak by doing a restore in iTunes and supposedly will preserve your warranty, but don't take my word for it.

With anything newer than an iPhone 3G, you need to capture the SHSH blobs for any version you might want to revert to. SHSH blobs are digital signatures that sign the firmware to your particular phone.

You can do this without actually jailbreaking using TinyUmbrella.

When Apple comes out with a new firmware version, they stop signing the old version for your phone. If you don't have it, you can't go back.

That's not true anymore. Apple closed that hole last year with iOS5. You can't use your saved SHSH blobs to go back to an old version anymore, at least not as easily as you used to be able to.

You can use a new tool called iFaith and make a custom IPSW image and restore using that, but you can't even do this with the iPhone 4S and iPad 2 (anything that uses the A5).

You can, I have jail broken my phone, my tethering got messed up?? I restored it back to the OS of the time, went to the Apple Store and they replaced the phone. No questions asked.

No, I didn't. Honest... I ran out of gas. I... I had a flat tire. I didn't have enough money for cab fare. My tux didn't come back from the cleaners. An old friend came in from out of town. Someone stole my car. There was an earthquake.......

I wouldn't worry about voiding your warranty; I can't imagine it leaves a trail that isn't removed when you have to restore.

With that said, I restored mine after a weekend of running the unthethered jailbreak. I had tried the tethered and it worked fairly well. After a couple days, the phone just descended into chaos. iTunes media quit working, stock applications were core dumping.

I restored to stock FW and settings, ran it and after a couple more days it started doing it again. It's just too much hassle to be able to tether outside of the silly $20 a month rate for the few times a year I need it. Not to mention, giving up my grandfathered plan.

I JB my phone and I have AppleCare+

If something would happen to my phone all I need to do is dunk it in water and make sure the phone is fried.

If it doesn't power up they won't know it's JailBroken.

Oh, the irony!

Apple ran the 1984 tv ad for the mac, and now they are what they once advertised against.
