While not broadband related, this might be of note to our users who just don't want to register, employees who dish out dirt, or professional proxy-server trolls: one Kentucky lawmaker would like to make posting to the Internet anonymously illegal, according to local Kentucky ABC affiliate WTVQ. As usual with this sort of half-baked plan, it's not quite clear how Kentucky Representative Tim Couch hopes to accomplish this. Websites are certainly going to love their financial obligation:
If the bill becomes law, the website operator would have to pay if someone was allowed to post anonymously on their site. The fine would be five-hundred dollars for a first offense and one-thousand dollars for each offense after that. Representative Couch says he filed the bill in hopes of cutting down on online bullying. He says that has especially been a problem in his Eastern Kentucky district. Represntative Couch says enforcing this bill if it became law would be a challenge.
Yes, managing the anonymous activity of the entire Internet is a challenge. Shoving the entire universe into a mason jar for use as a personal flashlight would also be a pesky bother.

Not all people from Kentucky or living in Kentucky are cretins or brain-dead imbeciles, only a small percentage called politicians fit that category on a regular basis.Naturally there will be exceptions to that broad generalization. This does sound like something that some fundamentalist Bible-thumping hypocrite would sponsor though! Kentucky has a lot of wonderful people mixed in with the racists, bigots and hate mongers as well as technology challenged and tech-savvy people.

Have you ever seen the news story? It is basically a bunch of people talking to news reporters about how "anonymous posters" ruined their lives by stalking them and spamming their social networking site accounts. If that doesn't fit the description of "online bullying", I don't know what does.

I read the article, and what I mentioned fits the topic. Next time research before you insult, I'm sure many would appreciate it.

Best of luck fining all the spammers, scammers, and ID thieves... Personally I would think that those types of things are a lot worse than the droves of anonymous id10ts out there posting their anonymous words...

Definition of posting = ??? an email? a blog comment? a link with no description? a web page and/or site? ...on that last note, what about 'domains by proxy' and other such services? sure they have to give out the info when lawfully required, but what would this sort of proposed idea do?

This sounds like a can of spam that this lawmaker simply shouldn't try to open.

Why not make it illegal? Plenty of illegal things already happen on the internet on a regular basis with little or no means to enforce the law or even catch the perpetrators...

If only I had access to sewer of the giant toilet they're flushing tax dollars down...

Despite the fact that it is unconstitutional (the Supreme Court has already upheld the right to post anonymously on the Internet in other cases) and that it is unenforceable (how will Kentucky punish a site based in Canada for allowing a user likely from Australia to post anonymously), this has all the marks of a law intended for selective enforcement. Meaning that it wouldn't be enforced at all until you found a site that you didn't like and then you would find a way to apply it to them.

For example, one of the Slashdot comments on this article pointed out KentuckyVotes.org. Apparently, they put the Kentucky legislature's bills online and let people search through them and comment on them. Some legislators don't like this. (Why should the people have access to voting records or be able to comment on bills? Who do they think they are?) So this site could either be fined for allowing anonymous individuals to post or be forced to give up personally identifying information on posters whose opinions irk the legislators.

A. At least annually, a registrar must present to the Registrant the current WHOIS information, and remind the registrant that provision of false WHOIS information can be grounds for cancellation of their domain name registration. Registrants must review their WHOIS data, and make any corrections.

Your ISP will have a log of whatever IP address you had, even if it is dynamic it can be logged, and of course its logged by whatever site you go to. Logs do include time stamps. Just make it mandatory in terms of record keeping. I'm not saying this law would be good or make any sense, Im just pointing this out to those who say it cant be done.

That's what I wondered at first, but they are about 16 years apart in age (Tim the QB is younger). They are from the same town/area in Kentucky, however. Maybe they are related, given the same last name.

Ok for starters, if they succeed (and thats a damn big IF) they would only be able to enforce it on one of two entities; those posting in Kentucky or those posting a site in Kentucky. The second part can easily be handled but ummm how are they going to determine the first? After all isn't part of being anonymous to NOT disclose your location? So just how do they plan to target those that live in Kentucky?

And before you say it, I know the policing is going to fall on the server operators and they will just go after them. But my point still stands, they will only be able to enforce it for sites hosted in Kentucky. They can't honestly expect DSLR to abide by Kentucky laws when they are hosted in NYC?

Is this the same Tim Couch who was the Quarterback for the Kentucky Wildcats back in the 90's? He was an awesome college QB, but obviously lacking in brains.

I've always hated these former athletes getting involved in Congress. This is a perfect illustration as to why -- too many hits on the football field damages their frontal cortex.
