Net-Neutrality Law Moves Forward
House Judiciary Committee approves, 20-13

The U.S. House Judiciary Committee today approved network neutrality legislation by a vote of 20-13. The "Internet Freedom and Nondiscrimination Act of 2006" would amend antitrust law to include provisions banning incumbent broadband providers from discriminating against unaffiliated services, content and applications. Before you get too excited you might want to watch your back for the side effects and unintended consequences that accompany pretty much all preemptive legislation.

I hope I'm wrong, but legislation that accurately targets an issue and is written well enough to not be able to be bent to someone's will is hard to come by...especially when it's written to address an issue that currently only exists in the minds and pr statements of a group of executives.

As I read it, it looks pretty comprehensive, especially for a document that's only 5 pages long.

•No interfering with content from content providers unaffiliated with broadband provider
•No enhancing a type of content from 'affiliated' providers, unless the same type of content is enhanced for all content providers
•No charging more for 'enhanced' delivery of content from an 'affiliated' provider

Wait until the riders get tossed on. A rule making it illegal to call an illegal illegal. Another rule giving congress a pay raise. Another rule making Spanish the official language.
(Well, maybe I am silly, but that simple 5 page item could be a hundred more pages of garbage that should be vetoed by the time it gets to the prez, and of course Bush is a *blank* because in the process of vetoing 100 pages of garbage, the 5 pages we want will get caught in the crossfire. Congress is not stupid.)

Bush doesn't veto anything, never has and never will. He just attaches a presidental signing memo stating that he doesn't agree with constitutionality of the law by his interpretation of it, and therefore will instruct the executive branch not to enforce it. Apparently he's done this 750 times already.. that's right.. 750.

I read that Bush recently broke the last record of days gone without a veto set by Thomas Jefferson (who also did not do a veto at all). Since 1789 there have been seven (not counting the current Bush) presidents that have not exercised any type of veto (although some people point out that times were different for those presidents). He has threatened a couple of times and apparently got the bills in question changed, so he does USE the power of veto, just has not exercised it yet.

I would rather he veto the bills, as it gives the legistlature that chance to disagree with his interpretation. Instead he just says "Go ahead and sign whatever you want into law.. I'll just ignore it anyway."

It has to pass through the Senate and I am very sure they'll add some vague clause at 0300 in the basement of the Senate bldg and bury it under hundreds of pages of legalese so as not to be too obvious about it. And the gullible, overpaid f*cks elected leaders who claim to be in favor of Net Neutrality most likely won't bother to read it before agreeing. (just like they couldn't be bothered to read the Patriot Act either).

Dueling bills in House: who will win on floor vote??

The measure, approved by a vote of 20-13, would amend U.S. antitrust law. It would also counter a rival bill from another House committee that wants to encourage network providers to preserve consumers' ability to freely surf the Internet instead of adopting stricter rules.

The Judiciary panel has been tangling with the House Energy and Commerce Committee over jurisdiction on the Internet issue, dubbed "Net neutrality."

The Commerce Committee has already sent to the House floor a measure that includes provisions that would codify principles the Federal Communications Commission adopted last year that encourages Internet service providers to ensure consumers can go where they want to on the open Internet.

It was unclear how the House leadership would resolve the differences between the committees.

Committee votes are not always recorded by voter, unlike House floor votes. But you could go to the House Judiciary web page to see if they put it there:

One news item I saw said all Democrats(14) on the committee voted for it and 6 Republicans voted for it too.

Approve Net Neutrality

I really do hope this passes.

As some one who has stakes in a local up start ISP, this is something we want to see. On a large scale this can not only help end users, but also for those smaller companies who do not want some monopoly company to have another poll over us.

This is something I really would like to see pass as law and would be one of the few times in history where I would feel Congress had done something for the people and not just their pocket books.

Part of the problem with Net Neutrality is the lack of clear explanation to Joe Sixpack. The Anti brigade (i.e. ATT et al) have tried to hijack the issue by claiming they are the ones "preventing the internet being regulated"

Actually the confusion is because MoveOn.org are opposing a different law that some in congress are trying to push that ALLOWS net providers to discriminate. This is of course the opposite to this bill.

it means that your ISP cant legally double dip. by double dipping i mean they cant charge you for the service and then bill google for the bandwidth that you use going to to google and have paid for with your sub.

what the ISPs want to do is be able to not only bill their users but bill the content providers their users go to.

I'm not so sure that is the current position the network providers are placing themselves in. Its just as easy to place their subscribers in a low-tier QoS environment by controlling via ACL (IP). If they want better performance to certain destinations or across certain ports then they can and will be assessed a monthly premium charge.

This eliminates the Googles.

Here's my favorite:
Citing networks that sell episodes of hit TV shows online, Rocco said: “They’re making money through our pipe,” but then “turn around and `say don’t let Rocco charge anybody for this usage.’”
You charge US for this usage you Tool. And the ISP for "networks" charges them as well. That's how it works. This would be like charging someone who is NOT your customer to call your customers.
