A federal judge in New York rejected the RIAA's claim that a Kazaa user who "made available" copyrighted material violated the law. According to the Judge, the RIAA "would have to demonstrate that unlawful copying actually took place," according to CNET
. Some think this means the RIAA can't win a court case against you simply for making your P2P files available online -- they would need to show that an actual illegal copy was made. Techdirt
meanwhile notes that things may not be quite so cut and dry, and this actually may be a win for the RIAA.
