New Zealand Tries to Sneak 'Three Strikes' Through
In Emergency Session Intended for Earthquake Relief

We've long discussed how laws requiring users be booted offline for copyright infringement have a number of very serious problems, including higher costs for ISPs (read: consumers), the problems surrounding accusation accuracy, the problems tracking users across ISPs -- and more. Several years ago New Zealand lawmakers at the behest of the entertainment industry tried to pass a law that required broadband users be disconnected from the Internet -- simply for being accused of trading copyrighted files. The effort was suspended after a significant public backlash, but Boing Boing notes the effort has re-emerged, piggybacking on Christchurch earthquake relief efforts:

The government of New Zealand is sneaking in its controversial "3-strikes" Internet disconnection law tonight as part of its emergency legislation dealing with the Christchurch earthquke. Bill 92A was passed once before and then rescinded after massive popular demonstrations, letter writing campaigns and outrage. It provided for the disconnection of entire families from the Internet after being accused -- without proof or due process -- of copyright infringement.

Using an emergency legislative session intended for earthquake relief to rush through controversial copyright legislation isn't sitting well with New Zealanders, who claim that the bill is actually worse than the original version, and still simply assumes all accused copyright infringers are automatically guilty. Some politicians opposed to the disconnection requirements for ISPs were shocked by the bill's sudden appearance at emergency session, but have so far failed to get amendments passed that would strip the requirements from the measure.

Tip for lawmakers

Here's a helpful tip for lawmakers: If you have to slip your bill through in an emergency session (called for something completely unrelated) without giving anyone notice of the bill's arrival then your bill is a bad one and shouldn't see the light of day.

Latest version makes disconnect almost impossible

Speaking in Parliament after the vote this evening, Labour communications and IT spokeswoman Clare Curran said her party opposed internet account termination for copyright infringers.

But it supported the bill because its compromise version only allowed for a person's internet account to be cut off by an order in council. Such an order can only be issued by a cabinet minister and has to be signed by the Governor General - a much more high-level process than the three-strikes-and-you're-out warning-then-disconnection regime originally outline in the notorious (and now scrapped) Section 92a.

The latest version of the 3 strikes laws has such a high hurdle to disconnect a user it is almost meaningless. Nothing to get wound up about.

But at cabinet minister and governor general level, disconnects would be so far down on their priority tasks as to be very rare.

What a lack of good morale...

I don't believe Copyright bills constitute as an emergency, regardless of the situation. For something like this to be pushed into a meeting regarding a natural disaster (something serious), it is shameful. It just goes to show how bad this train of though of "I want it NOW!" is, especially with Copyright these days.

The way I see it, that bill should simply be thrown out over presentation, regardless of it's content.

What "the people" really need to do, is push for separation in Bills. One Bill, one project. Even though that does add time to the politicians day, to "discuss" "each" Bill.

Meaning that if it's a bill for the earthquake, Only "that particular earthquake" related things can be in it, and not just add in for other things like "3 strikes and you are out, you innocent bastards".
How many Bills have had some sort of kick back money for a certain area, buried deep and in some vague terms to what it is for. Like a bridge up north that is already fully earthquake resistant, but needs to be a different color for some politicians floozies birthday(called the "current paint color is distracting to drivers" Bill, and including in the Bill "inspection of joints/rivets while painting", which is actually covered under current financing).

I agree 100% with the one bill (of related matter) and one vote. I disagree it would take more time to deal with each bill though.

For every "attached" item there will be some kind of discussion unless it is just blanketly approved by all. And if that is the case it would pass in seconds anyway.

I would also further this by saying ALL votes must be done electronically by ALL members of congress with option comments. No missing a vote as they can be done remotely or over a couple days time. In this day and age there is absolutely no reason votes cant be administered electronically and the public to have access to exactly who voted what and why if they so choose to explain.

I agree about all members having to vote on bills especially. for the money that lawmakers get(at least here in the USA) they should have to work just as many days of the year as a cubical slave does. Congressman get paid lots of money and do almost no work. the cashier at a supermarket does more work a year than a few congress critters combined.

I just cant wait until one of these lawmakers is hit by their own draconian rule when one of these lawmakers children violates the "three strikes" law trying to get the latest Lady Gaga CD rip off a P2P client and gets Daddy lawmakers internet connection shut off.

Sounds like something that Anonymous would do. I seem to recall reading something saying that some of them were aiming their LOIC's at the NZ government because of this.

Talk about corruption. Jeez. Only a few Greens and Independents have any integrity there apparently.

I don't know how New Zealand addresses lobbying and corporate corruption of the democratic process, but I'd like to think these series of anti-consumer legislations being desperately pushed through by almost all politicians will be a major wake-up call to the New Zealand populace of how businesses are slowly taking control of their government.

Same as America, repeated and is the result of an industry with time and money on it's hands and both NZ & American governments who aside from their teenage kids; don't have a clue how services are used; or much at all about technology.
