Some time back we mentioned the case of a substitute teacher who faced 40 years in jail for exposing a class of seventh graders to porn. Her defense, which netted her a lot of Internet support among technologists and bloggers -- was that the broadband connected (and apparently poorly secured) classroom PC she was using was infected with spyware and had been spewing porn popups. Users in our security forum point out that she's received a new trial, thanks to new evidence that surfaced after her conviction last January.

They saw a little bit of porn - most likely unintentionally. Get over it.

And they're seventh graders. It's nothing they won't be downloading themselves within a year.

I think she has a very good chance, seeing as how I'd bet at least some of the jury members have had this same problem.

so what does that do to them exactly? Make them hungry? I'm not sure showing breasts to someone who thinks of them as a food source is doing anything. If the kids had hit puberty that would be something else.

actually the US justice system is one of the harshest systems among other developed economies. It's true that celeberties do get a break here, but in Europe they might not have been penalized at all (because of their status). Other than that - we have a very "punishing" system. In Europe, convicts get lesser penalties.

I do not know where you get that info, in europen some country when you are giving 30 years you will do 30 years no parole is not the same case in usa.

yes, but much fewer people will get 30 years - it's not like here - where we have these penalties left and right. Why do we have parole and other defense mechamisms - b/c we need them to mitigate the harshness of the results.

Actually most in Paris Hilton's situation gets 5 days unless you have an accident. Driving offenses in California is really the problem. There aren't many penalties. Get a DUI in Florida and the DL is gone for 1 year.

Our legal system is setup to run over anybody without the financial means to really put up a good fight. I think its a poor excuse for justice. I'm glad sombody saw the folly so the lady gets another chance. Hopefully the courts dont screw up again. That porn spam is really bad news trying to close it. And there is no law that says computer dingbats have to go to prison.

Yeah, I have seen that mess of a problem before. A customers computer had it, and if you closed the ad, 3 more came
popped up, and of those 3, closing those will generate more. So cleaning up and closing the ad makes the problem worse. I have sided with the substitute on this one even after the court ruled her guilty. I hope she wins.

But then again, this might be an attempt by the courts to discourage stupid people from getting computers. Since she's a substitute this wouldn't be her computer, so she shouldn't goto jail, unless they determine the spyware/popup software was installed by her without a shadow of a doubt. But I DO agree that the justice system should make "computer illiterate" a crime to a certain degree, because a computer is a valuable tool that should not be used unless you have at least basic knowledge about spyware and firewalls. I think if you don't know how to install your O/S from scratch or install hardware, then you shouldn't have one without a class or tutor. But that'll never be the case.

I read what happen the the lady, forty years for something she could have done little about. If she had been running FireFox it would never have happened. I remember once I got into a porn page and in seconds it dumped over 20 pages on me and every time I closed down one 5 or 6 more would pop up. This was with a earlier version of explorer. This is what got me to try Firefox and have been using it every since. Semebody was looking for votes in the next election.

Suing everything that evinces life force and was associated with this obvious case of barratry and perjury.

I suspect that when this thing is drilled down into, you will find that the school district has a very well-connected IT manager/consultant who falsified work order completions and maintenance billing and lied to the prosecutors to save his butt.

Just a guess. If this is the case, it should not absolve anyone else involved in bringing this gross miscarraige of justice. Prosecutors, judges, school officials and the parents who whipped this along, she should go for the jugular with all of them. Rip their guts out, in the finest legal sense.

An episode worthy of the era of The Salem Witch Trials, only more egregious, because it is now, not the 1600's.

Complete crap the school district involved screwed over the substitute teacher who probably did not have any union representation, so they would not get nailed for not having the proper filtering on their computers. Typical which is why I got out of teaching years ago. If you are a single male in a classroom setting you can have some sweetie accuse you of anything they want and you are destroyed even though the charges are complete crap the school system will ruin you and the sweetie who makes the charges even if they are proved to be total fabrications she gets off Scott free, and is untouchable.

Even if she gets off, I say there is no justice unless everyone who did their job trying the case are put in jail for 40 years. Because all this teacher did was go to work, if that's a crime, put everyone away.

Do you impair the morals of a child by showing them porn. These weren't even children almost they were fucking 12 the legal definition of child is someone under 13 so they were almost adolescents. I bet the so called children are just too scared to admit they clicked on the fucking porn and enjoyed it because they have been told it corrupts their morals. The reality of the situation is these kid saw nothing they had not seen before. When we first got internet access here at work and before they installed filters you could tell the age of the teenager who was surfing. Broadband was a uncommon thing in those days. Jr High it was T&A, finally winding up with bestiality, bondage, you name it. I always checked the web history of the computer I was on and cleared it out to make sure nobody though I was visiting these sites.

If I had been in this teacher's shoes I would have unplugged the computer and told the school to get the damn thing out of the room, unfortunately a substitute teacher just does not have the power to do much, and a school district will screw over a substitute every time.

If anyone should be going to jail it should be the IT guy and whoever 'wrote' her up over this. Not to mention the prosecutors and judge, as they should be hung for allowing such a bullsh*t case to even get to court.

She is not in trouble for having a couple of pop-ups appear, which the kids briefly saw. She is in trouble for not handling the situation well over the next several hours, as pop-ups continued to pop-up, and she failed to take reasonable steps to handle the situation. She doesn't deserve jail over this, but she deserves to be told to seek another profession, as she is not competent to be in charge of a room full of kids.

Legal Action Against Courts for Miscarriage of Justice?

If this woman served jail time due to this travesty of justice, I hope the state pays her for wrongful imprisonment. I would make a HUGE stink once that not guilty verdict gets read (which it hopefully will be). If I were her, I'd go on the talk show circuit pointing out the incompetence of the Original Judge, Prosecutor, and All else involved. Of course, if the judge who heard the case initially threw it out, I would spare him the embarrassment. However, I would string that prosecutor by his feet and demand a resignation for failing to do his job properly. Enough public pressure can often make this happen.
