It's true that celeberties do get a break here, but in Europe they might not have been penalized at all (because of their status). Other than that - we have a very "punishing" system. A customers computer had it, and if you closed the ad, 3 more came popped up, and of those 3, closing those will generate more. So cleaning up and closing the ad makes the problem worse. I have sided with the substitute on this one even after the court ruled her guilty. I hope she wins.
But then again, this might be an attempt by the courts to discourage stupid people from getting computers. Since she's a substitute this wouldn't be her computer, so she shouldn't goto jail, unless they determine the spyware/popup software was installed by her without a shadow of a doubt. But I DO agree that the justice system should make "computer illiterate" a crime to a certain degree, because a computer is a valuable tool that should not be used unless you have at least basic knowledge about spyware and firewalls. I think if you don't know how to install your O/S from scratch or install hardware, then you shouldn't have one without a class or tutor. But that'll never be the case. | |

I remember once I got into a porn page and in seconds it dumped over 20 pages on me and every time I closed down one 5 or 6 more would pop up. This was with a earlier version of explorer. Just a guess. If this is the case, it should not absolve anyone else involved in bringing this gross miscarraige of justice. Prosecutors, judges, school officials and the parents who whipped this along, she should go for the jugular with all of them. Rip their guts out, in the finest legal sense.

When we first got internet access here at work and before they installed filters you could tell the age of the teenager who was surfing. Broadband was a uncommon thing in those days. Jr High it was T&A, finally winding up with bestiality, bondage, you name it. I always checked the web history of the computer I was on and cleared it out to make sure nobody though I was visiting these sites.
If I had been in this teacher's shoes I would have unplugged the computer and told the school to get the damn thing out of the room, unfortunately a substitute teacher just does not have the power to do much, and a school district will screw over a substitute every time. -- Remember safe sex does not prevent crabs. | |

She is in trouble for not handling the situation well over the next several hours, as pop-ups continued to pop-up, and she failed to take reasonable steps to handle the situation. She doesn't deserve jail over this, but she deserves to be told to seek another profession, as she is not competent to be in charge of a room full of kids. | |

| Legal Action Against Courts for Miscarriage of Justice? If this woman served jail time due to this travesty of justice, I hope the state pays her for wrongful imprisonment. I would make a HUGE stink once that not guilty verdict gets read (which it hopefully will be). If I were her, I'd go on the talk show circuit pointing out the incompetence of the Original Judge, Prosecutor, and All else involved. Of course, if the judge who heard the case initially threw it out, I would spare him the embarrassment. However, I would string that prosecutor by his feet and demand a resignation for failing to do his job properly. Enough public pressure can often make this happen. | |
