The entire civil legal system in the USA needs reform to prevent this sort of abuse. We can start by mandating that winning civil lawsuits requires the same burden of proof that is required for a conviction in a criminal case. That is, a defendant is presumed "not liable" until he or she is proved liable by way of evidence that meets the "beyond a reasonable doubt" legal definition. -- "At the moment of conception."

Good luck with getting preponderance of the evidence ratcheted up to beyond a reasonable doubt. The deal is all but signed by the Senate to have the U.S. Atty General bring **AA copyright suits against alleged infringers. Oh, and if the $enate pa$$e$ this bill, our tax dollars will finance the lawsuits . On behalf of the **AAs. -- The Toll

Notwithstanding your naivete, these cases won't be converted from civil to criminal...if you read the substance of the bill in question, you'll see that they will -in fact- remain in civil court, except the **AAs want the DoJ to bring suit and police their alleged copyrights for them. Nothing changes but for the fact the **AAs questionable suits will now be financed on the taxpayer dime instead of their own. -- The Toll

Most of the accused have no way to defend nor afford to hire a good attorney....so they just roll over. -- So Obama says McCain voted with Bush 90% of the time. | I know!! It's a shame the RIAA even has to do this! The RIAA is trying to do what is right through honorable actions and this guy keeps on dishonestly defending the very thieves that the RIAA is trying to bring to Justice.
History shows that the RIAA is very competent and has been nothing but honest about it's intentions and respectful of the law.
This guy is getting what he deserves as no one should be able to step up and defend someone against the RIAA. That is just plain wrong.

Do you have proof that the lawyer in this case acted in such a manner or are you just painting every defense lawyer with a mile wide brush? Actually, in my mind, the biggest problem with his statement is at the very end, "do everything legal 'or not'". Any lawyer, defense or otherwise is obligated to follow the law. Prove otherwise. It's that same kind of whisper campaign used on a certain presidential candidate. Make implications without actual charges, and eventually it becomes 'common knowledge', even though it's still a lie. Just like 'all defense lawyers lie to get their client off'. As someone said earlier, 'until YOU need a lawyer to defend you against bogus charges. I would also point out that if the bar for civil evidence was as high as it is for criminal, OJ would have won his civil suit.

| RIAA can't even get filing right Readers should note the cover sheet (.pdf) of the court filing lists Richard Gabriel as the RIAA's lead counsel. Gabriel was named a Colorado judge in May and no longer works on behalf of the RIAA.
Yes, I'm sure a company that has sued 30,000 people, including dead people, and can't even get this filing correct is a fine upstanding organization that is being unfairly targeted by Mr. Beckerman.

| This could backfire big time Beckerman appears a very effective lawyer who takes his role in the Judicial system very seriously. For the RIAA to "take him on" in thew same Judicial system could well backfire if Judges feel this action is not only unwarranted but is systemic of the RIA bullying quasi-legal approach. | |
