Samsung Adds iPhone 5 to Ongoing Lawsuits
iPhone 5 Violates Samsung's LTE Patents, Says Company
by Karl Bode Thursday 20-Sep-2012 tags: legal · business · wireless · hardware · wireless
As expected, Samsung has added the iPhone 5 to their platter of existing lawsuits against Apple. "Apple continues to take aggressive legal measures that will limit market competition," said Samsung in a prepared statement. "Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights," says the company. Samsung owns about 12% of the 3,000 existing LTE patents (Nokia owns 18.9% and Qualcomm owns 12.2%), and the lawsuit revisions will likely primarily focus on LTE. While Samsung recently lost a $1 billion court ruling in the States, their battle with Apple is global, the companies engaged in fifty different patent disputes in ten different countries.

You mean a rectangle with rounded edges? Yeah that's patent worthy. I had wood blocks as a kid that had rounded edges, of only I patented the shape...

I blame both. The Patent Office for granting such a ludicrously broad patent, and the holder for abusing such to stem competition because an icon looks just a little too similar - though this is not to be confused with trademarks suits such as that by Sony against Clearwire. Let's be honest, that logo for Clearwire DID look pretty darn similar to Sony's Ericsson logo.

I see. So if the government says a company is allowed to patent an idea, you are going to cry foul on the company when they decide to patent an idea. That makes no sense. It's called playing by the rules.

Not quite, though I see how my statement could give such a connotation.

Let me be a bit more concise: I don't claim to be an expert on patents. For that matter, IANAL. But I know something is ludicrous when I see it; and there's no way that a rectangle with a rounded edge is a logical patent. If it is, then whoever made this logo right here has got problems ahead of them (Despite predating the iPhone).

Once upon a time being a slaveowner, and beating your wife meant you were playing by the rules. In the end I imagine we are judged not based on how we explited the loopholes of our time's unrefined laws and thought processes but rather on our common sense, good judgment in spite of society's flaws, and decency.

Re: good...

You are going to compare protecting a patent to owning slaves and beating a wife just to try to prove a point? Wow. Just wow. I had no idea there was so much irrational Apple hate out there.

Re: good...

The comparison is not that irrational since they both used to be legal... that was the point. Also, since this thread is really about Samsung defending a patent, if Samsung wins the lawsuit and the iPhone 5 is blocked from being sold in the US would you be fine with that?

Ohhhh that's just wrong.

Apple has taken many lessons from Monster Cable it seems, by suing anyone and everyone that even slightly resembles them. Monster Cable sued everyone for using the word monster no matter what it referred to (including a family fun park, and a vintage clothing store)

Suing a grocery store in POLAND... wow.

Yea, since Apple knows how to game the system they should get whatever. It doesn't matter if it's right or wrong. It just matters that they can game the system.

Yes because we should always take advantage of flaws in the system for our own personal or in Apples case corporate gain. I'm sorry but just because they were able to do it doesn't make them less a bunch of douche bags.

actually it's supposed to matter what we think. if the system as a whole is working correctly and enough people pressure their elected representation the laws can be changed. however due to the $$ being spread around sadly in effect you're statement is correct. the law is what it is and even though it is horribly broken it won't be fixed any time soon.

They have patents on things that are prior art. Have you ever seen a phone with sharp corners? Nope, they are all rounded...
Some patents are retarded and many are issued without even doing checks on whether the things already exist. Some time ago a guy patented the wheel. Yes, that's right. The patent was issued for a "circular transportation facilitation device"...

And Samsung is defending theirs. What's good for the goose is good for the gander. Unfortunately in the end it's the consumers that are stuck paying for the the fowl stench of corporate litigation.

Since Apple is such a big fan of patent enforcement I'm sure they'll understand HTC and Samsung moving to block them from using the LTE technology they have infringed on, right?

I mean they wouldn't be in any way hypocrites, right? I mean this is APPLE we're talking about.... in fact they should just voluntarily ban their own products.

I mean, you wouldn't want to act like a complete douchebag company. OH WAIT.....

Good point. How about you & I partner and register appsung.com/net/us/kr/biz/info,etc,etc,etc plus create some super lame (cheap) product for purpose of locking-up the trademark then sit back and wait. Could make ourselves a windfall while contributing nothing to society. Makes my American blood surge. What say you?

I wonder what the ifanboys would say...

If Apple went into the tv or car business, got some patents, and then suddenly you can only buy the $5000 Apple tv or the $100,000 Apple car?

UK litigation pending

Still waiting for that apology from Apple to Samsung in the UK, that should be priceless.

"Samsung has just gone Samsung's way, with a decision in Britain's High Court that Apple must run a national ad campaign saying that Samsung didn't copy Apple's tablet designs, and leave a note on its UK website to the same effect. "

Samsung doesn't stand a chance

Apple bought the LTE chipset from Qualcomm, who in turn has licensed it from the patent holders.

If this went through, it would create the largest clusterfuck you'd ever seen .
