Anti-piracy, anti-whistleblower pact being negotiated in Geneva...
08:32AM Thursday Jun 05 2008 by Karl Bode
tags: legal · world
Remember the international trade proposal recently leaked to Wikileaks that aims to "criminalize the non-profit facilitation of unauthorized information exchange on the internet?" That proposal (The Anti-Counterfeiting Trade Agreement, or ACTA) already took aim at BitTorrent websites like the Pirate Bay, but also potentially whistleblowers, and even legit distribution systems like Tor. Now new leaked information obtained by Google's William Patry suggests that mandatory ISP filters are also part of the proposal. Says one source:
"The rumors of what is in the draft are pretty much all bad and the scope is growing, not shrinking; it is even said that the latest version has filtering language in it."
Despite having a massive impact on Internet freedoms, the mainstream American press haven't really touched this story yet. The proposal is being negotiated in Geneva this week without much transparency. "Say what one will about the DMCA," says Petry. "The DMCA process was pretty open if ugly."

let me just un do my pants for the goverment

Ok I'm bent over I forgot the lube.. Oh wait I need to pay for this too!

Seriously wow I hope this isn't just a lets hit the big red panic button but I really hope someone somewhere has some common sense to say hey something is terribly wrong here not just from the stand point of piracy but privacy in general.

What is the motivation other than money to do all this? is anyone fighting for us the little guy? if any of this passes I'm cutting my internet connection.

I really wonder who is pushing for these I mean is it really IFPI, RIAA, MPAA I mean I know they all have money but c'mon this much broad power to force laws for large sections of the globe!

I'm anxious to see when this hits the media what the reaction will be of people I honestly think everyone will just sit back (in the US) and do nothing but bitch I really hope this is the last straw and we start rallying like they do in Sweden make our voices heard.

If something like Anonymous can have people picketing a religion why can't something like this have much more impact and force even more people to picket, protest, write letters and so forth.

You have such an optimistic view of the world. This will go through, people will be arrested, and the average Joe American won't even hear of it, much less care.

That's the way the US, and a lot of other countries, work.

I have hope and not trying to be ultra negative towards the situation yes it could suck very very very much but trying to put a light on it.

But your probably right if it isn't on TV or the "cool thing to do" nobody does anything and let their freedoms be eaten,

So how will this effect data exchange if I have a VPN running? Are they going to say they are illegal now as well without being able to peer in?

Like it is going to work anyhow

Russia thumbs its nose at us for the most part with all the scams that come out of their country. Nigeria still has a big business in trafficking of electronics bought with stolen credit cards and scams in general. China pirates software like there is no tomorrow. The list is endless.

So what happens when you go against the rules? Probably nothing.

Did you miss that Russia wants into the WTO badly and even fought an mp3 site to get in ?

This is a scary thing.

Yes and it will be under attack yet again when it gets to the front of the pack again.

Re: Who proposed this?

From the article:
"The US is negotiating ACTA through the Office of the US Trade Representative (USTR), an office within the Bush Administration that has concluded more than 10 “free trade” agreements in recent years, all of which require both the US and the other country to increase intellectual property rights enforcement measures beyond the international legal norms in the WTO-TRIPS Agreement.

- Rep. Mary Bono (R-CA)
- Rep. Bob Goodlatte (R-VA)
- Rep. Howard Berman (D-CA)
- Rep. Adam Schiff (D-CA)
- Rep. Marsha Blackburn (R-TN)"

Also from the article i.e. follow the money ...

"Rep. Howard Berman (D-CA)[4]

Top four campaign contributions for 2006:
Time Warner $21,000
News Corp $15,000
Sony Corp of America $14,000
Walt Disney Co $13,550
Top two Industries:
TV/Movies/Music $181,050
Lawyers/Law Firms $114,200"

It's going to be a hard sell considering we don't even have these proposals as law in the US and Bush is going down!

you get one guess and if the last two letters aren't AA, you're wrong. [caveat: could be the international org, which only has one A at the end].

if I am remembering correctly, this bill will also mandate that border guards search laptops for infringing content.

Believe it or not, this is being pushed by the EU even more than the US.

»williampatry.blogspot.com/2008/0···ret.html
Not that things are better in Europe. USTR is hardly the only one pushing for agreement and for acting in secret: the EU was an early and enthusiastic advocate.

Time for Encryption

All this means is that's it's time for people to start thinking about security and implementing encryption across the board so that no one can see any of your traffic as it passes through their routers.

If you think they aren't already watching your data, you need to look up some of the DOD projects that involve Gigabit level packet filtering, capture, and their want for realtime SSL decryption.

Just my 2 cents

Re: Time for Encryption

I remember that very nice and small application by nullsoft called "Waste"

Communication was encrypted and only people you knew were allowed to share on the same community by adding their encryption key to the allow list.

I still have the source code for the program.. Time to compile...

Press Release from US Trade Rep on ACTA - issued today

Statement from USTR Spokesman Sean Spicer on Anti-Counterfeiting Trade Agreement
(ACTA)

“Participants in discussions on the proposed Anti-Counterfeiting Trade Agreement met at the
U.S. Mission in Geneva June 3-4. This was one of a series of meetings through which the
participants plan to develop different aspects of the agreement.

“A number of topics were discussed. The main focus of the discussion was border measures,
particularly how to deal with large-scale intellectual property infringements, which can
frequently involve criminal elements and pose a threat to public health and safety. Participants
considered the discussions useful and are satisfied with the progress to date.

“Participants will continue their substantive work over the coming months in a focused manner.
They tentatively scheduled their next meeting for mid-July
, and expect to continue discussions
on border enforcement while also exploring other areas, such as civil enforcement. Participants
discussed future engagement with stakeholders and agreed to proceed with such engagement at
the domestic level and to identify opportunities for further engagement in the future.

“Participants included Australia, Canada, the European Union (represented by the European
Commission and Member States, including the EU Presidency (Slovenia)), Japan, Jordan, Korea,
Mexico, Morocco, New Zealand, Singapore, Switzerland, the United Arab Emirates, and the
United States.”

Again. There are more important things

There are more important things to do with tax payers money than "fixing piracy".

How about declaring war on gangs..?
Improving education?
Making college education more accessible to lower income families?
Fixing the economy?
Reducing dependency on foreign goods..?

On top of that there are many more other issues.

Congress needs to be updated with people that was born when PCs came out and not ran by people that was an adult during the race segregation.

Everyone that approves laws and make laws are so outdated that they dont even know how technology works..

Stupid idea

They can take their filters and shove it.

I just want an unfiltered, non-traffic shaped internet connection. Is that so hard? I had one a few years ago, why couldn't they just leave it alone?

Because you are worthless. The United States is run by massive corporations. If you do not have money to pay for the laws you want then you are not getting them. We run less on morals and good decency than before. We run on egocentrism and money. Most of the people in Congress and in other occupations are incompetent. They really care little about you, they however give much priority to the people with cash.

Cannot forget sleep deprivation and caffeine. America truly is great nowadays.

wow, so much for the consitution

hopefully, the next president tries to veto this if it gets passed, its a blatant violation of the first amendment ffs.

and if it does, count on the internet becoming unusable, if the RIAA is anything to go by how overzealous our country is getting with anti-everything.

i predict a few lawsuits if this does go through, which is possible but an unlikely scenario in its current form, thank god that bush is on his way out though, get some sane politicians into the WH and see what happens to this, if anything can be done.

I, for one, am hoping, praying, betting w/e that its not going to get passed, imo this bill pact treaty, whatever you want to call it, is the same as communism (for being able to censor ANYTHING whomever deems it unfit even if its not a piracy issue [China anyone?])

btw, i dont think the BT piracy figures are accurate anymore. A LOT of gaming sites, fan sub, and completely legal sites use bit torrent for updating their games, programs, releases etc. (MEAIT, IJJI, Bliz, GNG, and a quite a few others).

id speculate that around 55% to 65% (maybe as high as 75% on release days for some games or programs/music) is pirated, the rest is legal.

Go Dems!

The Democrats are really having fun so far in the 110th Congress. There may be an (R) next to the names of some sponsors, but if it passes remember who controlled both houses when it happens.

You probably chose to overlook this....

""The US is negotiating ACTA through the Office of the US Trade Representative (USTR), an office within the Bush Administration that has concluded more than 10 “free trade” agreements in recent years, all of which require both the US and the other country to increase intellectual property rights enforcement measures beyond the international legal norms in the WTO-TRIPS Agreement."

Not that it matters... I'm sure you already blame the Democrats for everything bad anyway.... That's the only way (R) can get re-elected, is if the people believe that only the Democrats are wrong...

Re: Go Dems!

Like the other's said, it is Congress and not the White House that really run things. The news loves to point at the White House because it is easier for us to blame one person with a face rather than 500+ seemingly faceless people. That person could be Bush, Clinton, Homer Simpson, "insert name here". Doesn't seem to matter who really. It is simple psychology to do so because our minds can wrap around that one person. Think of it like screaming at the ISP rep for all the mess ups on your network connection. Do you really think that rep sits there all day long like Dogbert hitting the Big Shinny Red "tick off user #42" button? As long as $$$ drives things, it will only get worse. I only remember one day where Congress actually seemed to be sane or moral and it took the two towers falling to make that happen...

Sad... so very sad.

Re: Go Dems!

I noticed however the "It's all Congress's fault" became VERY quiet when Clinton was in office and subsequently when Republicans controlled both houses.... Then they came ROARING back when the Democrats took control of the house.

Really it's an flawed ideology. It's so much easier to just blame Democrats for everything bad then having to admit that your whole belief system is fundamentally flawed and that your party lets you down continuously and constantly.

oh snap

@sbcglobal.net

I'm a Libertarian and former Democrat who obviously shares a lot of the same social views as Democrats, and even I have to say that the Dems are fucking up. The two parties don't stand for anything they did 20 years ago. Bipartisan politics mean nothing, as it's becoming a unified "big brother" government where they're enacting more social and fiscal control and taking away more and more of our liberties every day. It's almost like the Republicans and Democrats are giving themselves a pat on the back every time they agree on another piece of legislation, ignoring the fact that they're just both agreeing to fuck us.

This sickens me in a way I find almost indescribable. The internet is probably the defining moment of my generation and is accelerating social change and expanding personal liberties far beyond any other "movement" where people have access to information, and the corporations don't like that. It's gone largely unchecked and I feel like now that large corporations realize how much money is to be made in the regulation of it, they're paying politicians to make it happen. Disgusting.
