Sprint: We Don't Throttle Postpaid Users
Though We Reserve the Right To Kick Users Off Network

This morning we noted that much was being made of the fact that Sprint CEO Dan Hesse told investors at a conference this week that the company is throttling the top 1% of "unlimited" users. That seemed odd, given that Sprint has made a big deal out of their unlimited offerings, and has been running ads claiming the company doesn't throttle anyone. Sprint has since come out with a full statement stating that the claims, which originated with a report by Dow Jones newswires, are false.

Sprint says the company does not throttle any postpaid phone data users for on-network or off-network usage. They also continue to insist they're still the only major wireless carrier that offers truly unlimited data plans with no throttling, metering or overages for smartphone users. Apparently the Dow Jones reporter hallucinated the fact Hesse said they throttle, as Hesse was simply noting that Sprint boots extremely heavy users that violate Sprint's terms and conditions:

Sprint does have terms and conditions which prohibit certain types of data use that may impair other customers' usage or harm or interfere with the network. At yesterday’s investor conference, Sprint CEO Dan Hesse was referring to Sprint’s right to terminate service of data abusers who violate Sprint’s terms and conditions. Customers who abuse our network by violating the terms and conditions will be contacted by Sprint in an effort to have the customer change their usage to comply with their subscriber agreement. Customers who do not change their usage and remain in violation of the terms and conditions may be subject to actions reserved by Sprint, including but not limited to termination. Consistent with our advertising, engaging in such uses will not result in throttling for customers on unlimited data-included plans for phones.

Booting the really ridiculously heavy users (after having conversations with them) is pretty much par for the course. Still, as we noted this morning, Sprint's dedication to unlimited likely won't last long as their LTE build budget gets tight.

Two Stories?

Wow, two stories on the same subject today. I guess as the old saying goes, "There is no such thing as bad publicity". It keeps the Sprint name in the blogosphere.

Now if they would only fix the 3G speeds. The tower near my home has not been upgraded and is not scheduled to be upgraded in the next six months according to »network.sprint.com/.

They certainly threatened to boot me off...

I force roamed for 3 months to test this theory a while back (also I was ticked off because Sprint changed all users ToS and wouldn't let anyone out of contract for it) and Sprint sent me a nice little letter threatening to cut off my line if my usage didn't "go back to normal".

I typically use between 1 and 2GB of data on my Nexus S 4G/HTC Arrive devices on my line.

They DO monitor your consumption, and they WILL cut you off.

It averaged out to around 1-1.5GB of roaming data per month. The official ceiling for roaming data is 300MB, even though they tell you (in your Sprint.com account) that you have "unlimited" roaming data, at least that what it says when you go to look at your usage for the month.

I'm up to 30 GB so far for the month.. highest I've ever been was 45 GB but I ended up just limiting myself.

You seem to be mixing up two different issues. They are stating that they don't throttle users for on-network or off-network usage. In fact, I don't see how they could throttle anyone while they're roaming since, by definition, they aren't even using Sprint's network.

Now users who excessively roam can have their service terminated. Indeed if you look at their TOS it explicitly states this.

Actually, I quoted exactly what was told to me in the letter I received from Sprint. They told me that I had used too much roaming data over the course of those 3 Months (avg about 1-1.5GB per month each).

Just because I roamed on Verizon's network (which is the only other network Sprint could roam on) doesn't mean that they don't have a way to monitor usage. Even if it is something as a simple as an itemized bill of which numbers, from Sprint, roamed on the VZW network and consumed X amount of data.

Seems like Sprint would be silly to not have a way to monitor roaming users, as to prevent VZW for slapping them with a huge roaming bill, with no proof, am I right?

They could easily throttle user's off network IF they wanted, they aren't but they could.
Even when using a Partner network, the data is tunneled through Sprint's backend so they have complete control over you still.

my speeds were ridiculously slow (like 1xRTT speed) but I just streamed Netflix 8 hrs a day at work. It's amazing how much data is gobbled up, just by that one app alone, even on roaming.

either way, they are saying they don’t truly offer unlimited. they bait people with the unlimited advertisements and kick them off when they use it.

we need some sensible mobile data plans in the USA. $15 for 2GB, $20 for 5GB, $30 for 15Gb, etc..

isn't this a worse admission than actually throttling?

it's unlimited until we randomly decide a limit to tell you we'll kick you off our service.

I did 50 gigs on roaming on Sprint, I did indeed get kicked, I wanted to leave with no ETF.

Last year my 3G speeds were consistently over 1 meg download and close to 1 meg upload. Now I am lucky to get 200k down and the same up. I say they are throttling the 3G network to make their 4G network look even faster. It is an incentive to upgrade to 4G. If 3G was working like it should, most people would not want or need faster speeds. If I could get 1 meg down regularly on my smartphone, I wouldn't even think about needing 4G or anything faster.

I remember reading somewhere that 50% of your useage that was roaming was considered "excessive" and could result in the termination of your line of service. I roamed (on purpose) in an area that is know to have crappy sprint service using a TREO 755P. Didn't get anything from sprint and I used texting, surfing the web and did email ALOT everyday. However.. readon..

If any of you have upgraded to a "smartphone" or just got a new smartphone over the past year, you noticed that Sprint felt the need to tack on 10 bucks for "premium data usage". Not to mention I already had a "premium SERO" plan but that's beside the point. The issue is, not only do I pay more now just by going from a one android phone to another, it seems that Sprint doesn't want me using it's network to download large files. I recently went to download a 8mb file and I got a warning that "this file is too large for downloading, use WiFi to download this file". Humm.. So, I didn't think anything at first, but it's happend a few more times. I've not sit down and tried to figure out the sweetspot in file size but the bottom line is, Sprint DOES not only throttle but they also restrict the size of the file you download.

That is almost certainly an OS imposed limitation rather than a network one.

sucks for me. I just bought a Straight Talk LG Android that is unlimited. I don't think the unlimited will last long.
