Ben Edelman class action spyware fraud lawsuit

Anti-Spyware researcher and forum regular Ben Edelman has filed a class-action lawsuit against Yahoo for "partnering with spyware purveyors to perpetrate syndication fraud against advertisers," reports Eweek. Among other claims, the lawsuit alleges Yahoo uses its Overture network to make money off of typo-domain squatting. "[Instead] of safeguarding against such abuse, finding such practices and diligently putting a stop to them, [the] defendants have actually engaged in such abuses," the complaint states.

Oops, I meant partnered. Spin it how you want, but as soon as Yahoo crap started showing up with my SBC stuff (in the same envelope, on the SBC installation CD, etc)... That’s when my SBC service went downhill. After a year of their co-branded garbage, I went to Comcast. Comcast has been 4x as fast as SBC was, and without the Yahoo junk.

Screw SBC's installation CD, just install PPPOE (or RASPPPOE) and login to the modem with your user id and password, that simple.

court, and more specifically, huge costs, is the only thing that has an impact on large corporations. Nothing else does.

The alternative to taking them to court is to do nothing, just like what has been happening for the last 5 years. If you have ever had to remove spyware from your computer, you UNDOUBTEBLY will share my point of view.

Ben was the one who pointed out that major corporations like SBC and others whose names I can't recall now were paying spyware companies for advertising. Spyware is just hacking that got corporate sponsoship. So when you had a spyware program on your computer, every 3 minutes a giant ad for SBC would pop up on your screen and the only way to get rid of it was to reformat the drive.

I hope that Ben makes a fortune and can start a company that serves as a watch dog group. Maybe he could take some of the proceeds and go after some of the larger spammers?

Your wrong that consumers will get nothing. Like always the existing customers will get some sort of a cheap (not even barley worth it) discount. Not only that, they will have to buy something from either Yahoo or SBC just to get it!

How much does Ben get, and how much does the law firm get?

I don't know which is worse, "spyware" or bottom feeding class action plaintiffs.

Personally, I *hope* that Ben gets rich doing this, (although I doubt it). And all those people getting ripped off by Yahoo, they will be high-fiving each other and saying "Thanks Ben!" if and when he wins. Go Ben, go!

Advertisers are paying real dollars to be displayed on sites that won't damage their reputations. They sign contracts with Yahoo to NOT be displayed on certain types of sites. When Yahoo goes ahead and ignores them, it could hurt their reputations and ultimately their sales.

For example, they end up on a site that does pop-ups. How often have you heard people say - I'll never buy from them because they support those damned pop up ads. So, there can be real damages involved.

Honesly, I wonder if Ben Edelman has any scope whatsoever on just how deeply his efforts are appreciated by the end user !!

Filling lawsuits does not require a good pc/network. Nor does obvious reporting on really obvious issues like spyware. End users like regular joe does not care how spyware installs or what they do to install it on his/her computer. 99.99999999999999999999 of users never even heard of this Ben.

People who visit his web site already know the basic information he presents. It does not take a genius to find it, just takes a person without a job.

Maybe I should do this and sue few companies that are so staffed they can track every single partner 24/7.

Instead of ambulance chaser this guy is a internet chaser. Different type of lawyer, same result.

I wouldn't call him an internet chaser - Ben's work has been published here and in numerous reputable publications. He's done a lot of homework that has turned out to be very educational and useful! to the rest of us.

What I see here is that finally someone with the resources to stand up to this kind of abuse is doing so.

This is way outside of the circle of "let's sue McDonalds for actually serving hot coffee" types of crapola lawsuits.

Tell ya what, when you output the posative results that Ben Edelman does, you can be a somebody too. Until that time, as of your seeming little half-assed rant against someone that does, you merely come off as:

[1] Someone that constantly has an infected machine
[2] A jeolous security wannabe.
[3] A spammer.

Can you post a resume and achievements comparible to his?

No one should have to take our effort here on faith. The proof will be in the results -- the benefits we either do or do not bring to class members.

The initial message (above) definitely gives me too much credit: This suit isn't just my work ("Ben Edelman has filed..."), but rather the work of numerous attorneys. It's a joint effort, and if there's any credit due to those of us working on this issue, it's due as much to my co-counsel as it is to me.

Learning how to read,understand and create html coding is a task in itself, your knowledge is at the top of the realm which is why small business owners like myself can rest at ease knowing companies like yahoo and google can't screw the small guy's forever,
