Were customer lists obtained illegally?

It’s been more than a month since SunRocket went belly up, but apparently the company is still alive enough to file lawsuits. Earlier this month, we reported that it appeared that SunRocket’s liquidator sold the company’s customer list to Vonage. Vonage says they bought the list legally. However, SunRocket claims that Vonage tried unsuccessfully to purchase the list from them, and then obtained it illegally from the liquidator. SunRocket is seeking an injunction -- and cash, of course.

They should have worried about that while they were still in business, not try to sue someone after they royally dropped the ball. What were those customers supposed to do, go without a phone as a tribute to that fine SR service they received? The "list" means nothing, all those people obviously had to get another service, whether with Vonage or someone else.

Next they'll be trying to sue customers who went with other providers.

Too bad

Sorry...I can't support this. I feel for the SR customers that lost money on this company.

But if SR sues Vonage and wins then my Vonage price goes up. And, well, quite frankly I'm NOT paying for your loss.

Just my 2 cents. I'm sure this will rankle someone.

If a court finds out they did indeed obtain the list illegally, and they raise prices to offset this, then you'll have to switch companies if you don't want to pay for your provider's loss.

It's actually Vonages' fault here, not SR. They shouldn't have stolen the list for free advertising.

If they paid the liquidator then they didn't purchase it illegally. The liquidator may not have been allowed to sell it but that's not Vonage's issue. As I see it makes sense to do what Vonage did. First they tried to purchase the list from Sunrocket and they said no. Then, once the company went belly up they tried to buy it from the liquidator (who then had responsibility for all of the SunRocket assets) and they said yes. That's just normal business practices when a company goes out of business. At worst Vonage will have to give the data back to Sunrocket.

It's in injunction not to use it, thus it is Vonage's problem. And yes we will likely see something against the liquidator as well.

It would seem to me that other companies just cant stop suing Vonage...I guess they really are that much of a threat...

Pointless

I can't help thinking that whatever happened, and whatever the outcome, this is all rather pointless for the simple reason that I suspect the number of ex-SunRocket customers who were happy to receive a special offer from Vonage is rather more than those who would complain over what, at the end of the day, is just another piece of junk mail.

It's a conspiracy, man! Verizon or AT&T is behind it trying to finish up Vonage as well. It is strange that they see these little guys as a bigger threat to them than the cable companies.

That's because the cable companies telco brethren -- big, fat, bloated bureaucracies that are ready to collude at the first sign of the FCC declaring regulation free competition. The upstarts like Vonage are annoying because if nothing else, they bring price perspective to the consumer.

My Thoughts

I thought Sunrock didn't have a pulse, I thought they were dead, I thought they filed bankruptcy to circumvent their creditors and thousands of prepaid customers.

We acknowledged it and chalked it up as a loss. Now that everyone has accepted the loss and moved on they want to resurrect their non-existent status and sue someone. If they want to resurrect themselves, first refund the customers then sue, and in that order.

... If they are allowed sue, it should be against the liquidators and not Vonage. That's like suing someone for purchase an item from a pawn shop.

Sunrocket is dead.....

.....what the hell difference does it make to them who has the *customer list*? It's not like they were going to get those customers back, they're done. Everything is in the hands of the liquidators who, AFAIK, have the right to "sell" anything related to SR to the highest bidder to pay off the creditors that SR left hanging.

SR should have shown this much concern about paying their creditors and taking care of their customers while they were in business. Sounds like sour grapes to me.

Let me get this straight now.

SR abandons their customers. And I do mean abandons them.
No word from Capt. Hook before her and her pirates fled the ship.

They appoint the liquidators to do what it is they do..liquidate that floating piece of driftwood with so many customers still clinging to it for dear life.

Vonage BUYS the customer list from the liquidators.
Excuse me but doesn't that mean that SR DID get paid for them?

If not..there's an issue there between the liquidators and SR..and not Vonage and SR.

But instead..someone at SR in their final desperate hour ..apparently authorizes a lawsuit against Vonage.

You've got to be kidding me.

I'd love to represent Vonage in this one..and call to the stand BBR's entire SR forum members who got the shaft at the hands of Hook and her executive team at SR.

I'd have her wishing she never left AOL.

what's really messed up

is how these executives go from company to company, and their records for having run companies down apparently don't seem to follow them to their new jobs/employers? Someone will be stupid enough to hire the same people that ran one company into the ground, no matter what record they've had.

Hell, give me a bazillion dollars and I'll run YOUR company into the ground too. A heck of a lot faster than these other fools took to do the job.
