Opinion: gutting consumer protections fine, but don't pick on WOW

We've talked extensively of the FCC's dysfunction the last few years, be it Kevin Martin's well, Kevin-Martin-ness, Robert McDowell's fear mongering and disdain for reality, or Michael Copps tendency to rant extensively against an idiotic idea right before he votes for it.

Techmeme's top pundits are usually absent from most of these unsexy stories, eager to generate more hits by reviewing iPhone apps or promoting their own startups than say -- exploring how the FCC's effort to gut the video franchise system resulted in a laundry list of problems for rural American communities, or digging past the surface of FCC decisions that seem pro-consumer but are really just stage shows.

Only now that Commissioners are preparing to depart for jobs at telecom think tanks or lobbying firms, are some people noticing that we haven't exactly been stocking the FCC pond with the best and brightest. This week saw countless news outlets discover for the first time that FCC Commissioner Deborah Taylor Tate is, like many of her FCC colleagues, almost completely detached from reality.

The discovery was prompted by two speeches Tate gave this week aimed at pandering to her biggest constituents. In both speeches, Tate uses her platform to placate and lobby for industry -- regurgitating false broadband stats, praising Internet filters, declaring that video games are a leading cause of college dropouts, and cheerleading for digital rights management.

Tate's first speech was absolutely nothing more than an entertainment industry sales pitch, from her promotion of the industry's preferred digital fingerprinting and filtering technology from Audible Magic (which often doesn't work), to her use of over-inflated (and proven fabricated) statistics on piracy's economic impact. She tops off her inaccuracy trifecta by loyally praising DRM as "very effective" (Tate's clearly not a Spore player).

Tate's second speech was a combination of self-promotion and telecom lobbying, the Commissioner again using inaccurate data -- this time to paint a rosy broadband industry picture in order to shill for industry deregulation, promote AT&T-backed Connected Nation, and rant against net-neutrality. But it was one sentence on World Of Warcraft that garnered more news coverage than anything Tate's done while on staff at the FCC:
You might find it alarming that one of the top reasons for college drop-outs in the U.S. is online gaming addiction—such as World of Warcraft—which is played by 11 million individuals worldwide.
The backlash was immediate, creating a firestorm of indignation among bloggers. Be warned FCC commissioners: you can wage war against consumer protections until you're blue in the face, you can distort statistics until the very fabric of the universe begins to bend, and you can shill for your favorite corporations until you collapse from the weight of their contributions and free trips to Vegas -- but you best not malign everybody's favorite MMORPG.

Of course, like any good FCC Commissioner, Tate doesn't offer a source for her WOW statistics, highlighting how sourcing, science and data haven't recently been the FCC's strong suit. That's because positions are no longer based on technical specifics or science, but are forged out of partisan loyalty and a desire to please Commissioners' true constituents -- the companies they'll be lobbying for after they leave the FCC.

This dysfunction is bi-partisan in nature, and Tate's speeches this week highlight once again that maybe -- just maybe -- it's time to stock the FCC with technologists, network geniuses and experts in the field -- instead of partisan lawyers, lobbyists and yes-men and women. Not only might they objectively explore technical issues based on real science, they'd update the FCC website more than just once every half-decade.

the first sentence of which says...
"...phone company lobbyists couldn't sell 'franchise reform' on the federal level"...

You need to read the whole sentence...
"on the federal level via Ted Stevens".
Pretty bad when the guy being nailed for corruption won't take up a well funded lobby effort in Congress, but the FCC still will.

I read the whole sentence, and the whole news item, which was about state laws, not the FCC. Although, the link incorrectly references that the FCC "gutted" the video franchise system, there is nothing to back it up. In fact, that part says the opposite of the assertion. I thought it was a linking error, but maybe its just a misrepresentation.

There are no jobs listed now but there may be some listed as soon as the transition happens. But be prepared - getting a job with the fed govt is a long processes.

The Senate unanimously endorsed her appointment by Pres. Bush. Business is business.

Her FCC 'profile' says: "Commissioner Tate has worked extensively to facilitate market-based solutions to public policy issues. Drawing on her extensive experience at the state and local level, Commissioner Tate actively promotes cooperative federalism and public/private partnerships when it is time for the government to act. Often referred to as the “Children’s Commissioner,” she is a leading voice on issues affecting families and children, and has been at the forefront of the movement to ensure that advances in communications technologies benefit all Americans."

During the process to merge XM and Sirius she allegedly got her talking-points from a rep to "Clear Channel" radio (that opposed the combo).

More of the same, and a hint towards censorship....for the children?

Well maybe. She was appointed in 2005 when Martin took control of the fcc and the bush-cheney repuublicans still had not horrified most of america.

Are people really that stupid to not even research what statistics they spit out? I mean, I dated a statistician and was shocked when I learned that they aren't truthful. Well, their datasets are generated on data that is then filtered down to cater to the investigators query. In other words, painted they way they want you to see it.

Tate's regurgitation is clearly a sign that the gubberment still has no idea what is going on. But will gladly accept your lobbyist donation and junkets.

We all knew for years that there was something wrong with the FCC.

I guess this finally explains their incompetence. They aren't dumb.

They are Lobbyists.

Does anybody out there agree with me that lobbyists should be outlawed, and if they are ever caught making agreements with ANY politician then they should be extradited.

Hmm...I wonder if the PEOPLE can ever bribe congress.

Anyone out there who lobbies congress on any issue other than for themselves - is a lobbiest. So if you go to Congress on behalf of your community association, or your ISOC chapter, or for CPSR - YOU are a lobbiest. The reality is that congress needs input and information from the people most effected by what congress does -- you. Well its the K Street lobbiests that show up day in and day out - while the guy on the street says "The fcc stinks and wont listen to me" - doesnt show up - and gets ignored.

Democracy is messy and inefficient. Mussolini kept the trains running on time. Which do you want.

Finally - "something wrong with the fcc." Remember - this is the Bush-Cheneys. Martin worked on the bush campaign in florida and his wife works for cheney. There isnt something wrong with the "FCC" - there is something wrong with the "bush-cheneys" who systematically came in and drove EVERY federal agency into the ground. Think FEMA and Katrina. The bush-cheneys beleived in loyalty and that anyone who was not loyal was an enemy of the state to be destroyed.

A suggestion for those who think the FCC is truly FUBAR

Not to take anything away from this fine site, but comments left here are mostly only read by geeks like us, and in a couple of days are old news. If you really have some positive suggestions for reform of the FCC, why not go to »change.gov/ and leave your comments there? Obviously you will want to think through what you are going to say so you come across as a reasonably intelligent person, but there is the off chance that if enough people did that it would make a difference. It's not often that the government actually asks for citizen input and while nobody can predict how much weight the comments left there will carry, I'll bet they'd stand a better chance of being seen there than in an online forum. Just sayin'...

and, find your favorite organization, like EFF or CDT or ACLU and support them - and when they say "contact the FCC about X proceeding" - do it. Too frequently the only one's who show up are the K Street lobbiests.

The FCC folded to pressure from Congress to cancel their Dec mtg where Martin was going to try and hand M2Z Networks some wireless spectrum for their porn-free and fee-free 768 kbps internet plans. M2Z mgt is well stocked with 5 ex-FCC staffers. Martin also wanted to stick it to cable companies once again in another pending vote.

Federal Communications Commission Chairman Kevin Martin on Friday evening canceled next week's meeting at which the commission was scheduled to vote on a free Internet plan, after receiving a letter from key U.S. lawmakers asking him to hold off.

Sen. John Rockefeller, (D-W.Va.), and Rep. Henry Waxman, (D-Calif.), who will chair the Senate and House committees overseeing the FCC next year, earlier Friday sent a letter to Mr. Martin asking him to cease actions on controversial policy proposals.

Mr. Martin had proposed that the FCC vote Dec. 18 on rules for a sale of valuable airwaves that would have required the winning bidders to offer free Internet access to 95% of the country.

Under Mr. Martin's plan, the free Internet proposal would have been smut-free, including a filter for pornography. Adults over 18 would have been able to opt out. Civil rights groups had raised questions about that idea, worrying about whether it would interfere with users' privacy and free speech.

Mr. Martin also wanted the commission to vote next week on a plan opposed by the cable industry that would have strengthened TV networks in negotiations about how they are carried by cable providers.

"We received the letter from Senator Rockefeller and Congressman Waxman today and spoke with other offices," said FCC Spokesman Robert Kenny. "In light of the letter, it does not appear that there is consensus to move forward and the agenda meeting has been canceled."
Looks like Congress wants Martin GONE before the FCC tackles any more substantive issues before it.

Politicos v Staff

There is a difference between "staff" and the politically appointed leadership. This post, the title of which say "staff", is in fact about the politicos. The politicos get there positions thru political patronage and, as was seen with fema and katrina, may have no experience in the subject matter.

The career professional staff are civil servants whose staff is designed to be removed from political patronage. The civil servants are somewhat isolated from political favoritism and thus only have an incentive to get the job done (but see the recent dingell report about how the matians threated the staff as if the fcc were the kgb).

There is a civil servant staff there that believes in the work it is doing and has expertise to work toward that end. The staff was muzzled by the martians.

There is a big difference btw politico and staff.

The whole story reminds me of something more than 10 years old, and I think the culprit was Internet Relay Chat (IRC).
