Time Warner, MSG Retrans Feud Continues
Customers Pay Price as Neither Side Budges
by Karl Bode Tuesday 14-Feb-2012 tags: legal · Video · competition · fcc · business · cable · consumers · Time Warner Cable
Retransmission disputes between broadcasters and cable companies were ugly in 2011 -- and have only gotten uglier in 2012 . Customers have been bearing the brunt in these money battles, dealing with blackouts, annoying scrolling warnings, disingenuous PR campaigns and higher bills regardless of which side wins. One feud that hasn't yet resolved is Time Warner Cable's fight with MSG, which has left consumers unable to watch their favorite sports teams.

The talks, which broke down into press sniping in January have not seen any traction whatsoever, and the blackout is expected to last at least until April:

Their broadcast carriage agreement expired on December 31 and the two sides have not been able to strike a new deal, which means Time Warner Cable subscribers in the New York area are unable to watch Lin's sudden rise to fame. And the dispute could last until April, the end of the National Basketball Association's regular season, MSG Media President Michael Bair said last week. Time Warner says subscriber cancellations have so far been insignificant, but New Yorkers affected by the dispute are not happy and threatening to switch cable providers.

Regulators have so far chosen not to regulate this, arguing that it's just another business dispute. However, calls for government involvement continue to grow louder as the disputes get more and more obnoxious.

NBC..

has been blacked out here since early december. Much longer than MSG has yet it hasn't received any attention. NBC in our area has a lot of things on it like the superbowl for example amongst many other things. There are also 3 other channels that have gone black with NBC as well which includes FOX.

I have documented it here:
»[TWC] TWC South Texas has dropped some of our local stations

Also our local station has filed two FCC complaints since Time Warner stopped with the talks. They have also been running ads urging people to drop time warner and switch to other local providers that still run all the channels. They were also saying it on the news on NBC as well as CBS since both stations are in the same building.

Re: NBC..

Local affiliates have 2 options- be a must carry and be part of the basic offering or be a paid channel and be told to screw off. NBC chose the one they didn't like. And they should be told where to go. They want their cake and to eat it too and its about time they're told NO. A cable company should agree to their demands though and move their channel to a higher package or to its own tier. Any company that wants to be an ass can be moved there and when nobody buys that package they'll know why they're not getting any $$$.

and if both stations are in the same building their owned by the same company. And the FCC won't step in NBC gave up their right to that

But what happens if you change providers and next year this happens with them? that channel will urge you to switch back to TWC.

Re: NBC..

CBS and NBC stations may both be in the same building but are not owned by the same company. The NBC station moved in when they were looking for a bigger facility as their old one was pretty small. Both channels are owned by different owners but run a few stories that are the same.

Re: NBC..

So they're both under a different carriage agreement. What's your're point?

Advantage time warner...

Seems to me the longer it drags on, without customer defections, the better for time warner. Time isn't on the side of the content company as people will learn to accept and do without.

I would like to see Time Warner hold out and maybe break this endless cycle.

MSG and TWC

The dispute is about MSG wanting to be paid for the HD feed that was not supplied up until now. MSG was supplying TWC with a SD feed up until now. Since they now are forced by the FCC to supply both the SD and HD feed AND since TWC charges extra for HD, MSG feels that they should be paid more for supplying not only the SD but HD feed. The only reason why the TWC customers lost MSG is due to the argument about how much extra MSG should be paid for the HD feed. I do not know if MSG offered to continue to supply the SD feed (while the question of how much more to be paid since TWC is now getting the HD feed) or not or who pulled the plug on the SD feed so I do not know who is in the wrong. All that is known is that MSG asked for an increase which was less than what was being paid for the old SD-Only feed (ie: The old fee was $X and they were asking for less than $2X for the combined SD+HD feed). IMO they are entitled to more money due to the addition of the HD feed (which remember TWC charges extra for). The only question is how much more it is worth.

Re: MSG and TWC

you haveno idea what ur talking about. the hd feed has been on the nyc systems for years. even directv and overbuilder rcn had it. fcc can not force twc to carry both but of course its in their best interest to. get ur facts straight before posting garbage.

Wow. Every single sentence in that post is 100% incorrect.

The Buffalo Sabres who are the red headed step child of the MSG sports teams were the last MSG team to go HD. The first MSG HD telecast of the Buffalo Sabres premiered on Time Warner Cable on October 5th 2007 against the NY Islanders. During that season only home games were in HD and for most of the season, Time Warner was the only place to see the Sabres in HD. The other MSG teams were in HD and on Time Warner NYC a few years before the Sabres. And FYI, TW doesn’t charge extra for HD.

I think MSG/Dolan is looking for a 53% increase. It has to be hurting them terribly. For those who don't live here this blackout affects New York City where both teams play. Knicks & Rangers games, the city itself is blacked out. The hit to their advertising revenues must be massive plus they are in the process of a renovation that is in it's second year and is on going.

All that may well be true. But please, you're being a little credulous. MSG is owned by Comcast. If you go to MSG's Facebook page you'll see an ad recommending that if you are a TWC subscriber and want to see the games you should DROP YOUR CABLE PROVIDER. There's more to this dispute than a processing fee.

Nope. MSG is owned by Madison Square Garden, Inc.--a company that is owned by the same people who own Cablevison, the Dolan family. Comcast has nothing to do with it.

Acting like children

Dont really care. Again this is lazy business. Tw and MSG need to leave the consumer out of this and handle business like grown men and women. All businesses have disputes but this is the only one where you'll see this kind of "that's it I'm gonna tell my mom!" attitude.
There is also no need for government involvement. This isn't important stuff here. Its just entertainment and theres no shortage of entertainment these days. If any government official moves to get involved I'm going to need them to stop and call me. I'll find them something to to do. Like their jobs.
