Unpaid fees threaten transfer to Comcast, Adelphia deal

As part of the Adelphia deal, Time Warner has plans to transfer ownership of its Minneapolis cable franchise to Comcast. The city of Minneapolis claims that Time Warner owes them unpaid "cable modem Internet access" franchise fees for the past four years, and unless the money is paid, the city is unlikely to approve a transfer. Time Warner has claimed that it owes franchise fees on television service only. Approvals must be granted by Minneapolis and other affected municipalities before the transfers can go through.

Actually, it is more like extortion. The city has no right to levy franchise fees on cable modem services. It's been to the Supreme Court before. The city successfully got nearly a million out of Comcast over the same issue, but Comcast did not end up paying the fees.

Nor are they going to get away with witholding approval of the transfer. The law is that the city "must not unreasonably withhold approval".

The city is just trying to get income by pressuring TW. I doubt that TW will knuckle under.

That's nothing. How they manage to leaf through our million page tax code to avoid paying their fair share of taxes is a hoot.

they simply do not pay them. here where i live we have major banks like National City, US Bank, and 53 that do not pay property taxes. They're in the news paper every year when they remind people to pay their taxes that have not. and 53 just built a new bank as well here.

Adelphia operates under Chapter 11, TimeWarner doesn't. Adelphia isn't buying another company for ~16.5 billion dollars, TimeWarner will be.
Adelphia won't be increasing their revenue with this sale, Timewarner will be.

The FCC had determined Internet Access Charges shall be exempt from franchise fees several years ago.
But then all you whiners knew that already.

It's pay back time. Time Warner is now reaping the seeds they have sown over the years. I'll bet Time Warner was stone walling Minneapolis over the payment of their franchise fees. Bestially telling the city, ok so sue us.

What is Next

Ok so if i understand this correctly.

Time Warner hasn't paid there "cable modem internet access" Tax for the Past four years. Ok it's a company but if a private citizen EVER did that they'd have the Tax man on their back looking for there money.. What makes this "corporation" any different.. Don't pay your taxes , then you goto jail, PERIOD. When will the government step in. Once corporate America starts killing american citizens that don't have their ideals.. Who knows what next. There seems that a big problem keep getting worse. why not drag the CEO into the mayors office for a pay your bills meeting..
But then someone Chimes in "But they Employee People in the city".. so that gives them the right to take from the elderly and children? Because anyone with a decent education knows that a good portion of your taxes goto schools and programs for children and elderly.

I've heard it's only about cable modem internet access fees (taxes to those who can see through the smoke).
If that's the case, TW was correct in not collecting them from the subscribers for the local socialists.

Well someone asked how could they let them go this long without paying the fees. My local cable franshie board this year or last year bitching at bright house for not paying their bills. They have someone look over the books every so many years and at times they get way behind. 4 years I can believe after watching local meetings. I think cable companys always collect the money and forget to pay them the full amount. They probably make interest off it before they give it to them. LOL

This has gone on 4 years because Minneapolis knew it would lose if it pushed the point, and TW knew that the case, already a winner for TW, was getting better and easier every day.

Now that it's time to close this out, either Minneapolis will drop it or there will be a quick court case.

So every time I go through up-town and Mpls instead of seeing many TW trucks I now get to see Comcast tucks!

I wonder if they will sell out in areas like Eden Prairie and Chaska too? I know they both have TW.

What about ?

Adelphia did the same thing in Los Angeles,while these big corporations should be fined for not living up to it's contract(maybe performance clauses should be included) this gets me pissed that Municipalities have such shoddy porous bookkeeping,how much more are they "loosing" from other revenue sources while our schools,roads,and infrastructure falls down around us

City issue

This isn't an attempt to block any sale.

The city is threatening to block transfer of the franchise rights within the city. The city owns and grants franchise rights, so this is not a state or federal matter - I'm not sure why everyone's bringing it up. This matter only affects TWC subs in Minneapolis. The other cities in the Minneapolis footprint served by TWC will have to approve their own transfers as well.

FWIW, I am not in Minneapolis proper, but am in their TWC footprint and dread going back to Comcast (I am a former sub). TWC Minnesota run a smooth operation in comparison to Comcast here.

Further info

Everyone needs to get the correct information. Minneapolis is not blocking the sale because of Internet issue it is the fees of not carrying enough Local Cable Access programming/Channels under there contract. In Minnesota every city has these stupid demands to have PA programming and X number of channels in order to operate your system. The Cable access fees are one of the main reasons for rising costs of cable in Minnesota. The City of Burnsville is one of the worst. The Greedy Bastards jack up the local access fees all the time. THank goodness I moved away. Either TW or Comcast will be forced to pay or it will be the deal breaker. The City of Minneapolis has enough money issues and need every dollar. They just screwed the state on widing a freeway that is over due, they will do it to TW and Comcast.
