The 'Amazon Tax'

the new law argues that an e-tailer's physical presence includes "affiliate marketers."
This is ludicrous. Of course not. The "affiliate marketers" aren't employed by Amazon. They aren't part of the company at all. They're similar to an ad agency hired by the company to spread the word of the company's products and services. Should a state tax a company because the ad agency they hire happens to be located in that state? Obviously the New York state legislature thinks that the answer is "Yes." Then again, I shouldn't expect any better from the state government that ruled that telecommuters who work out of state need to pay taxes on their income to the state they live in *and* to New York state. What happens when Amazon retaliates by deciding not to have any "affiliate marketers" in the state of New York. IOW Amazon could tell it's "affiliate marketers" to move to another state.

All Amazon has to do is bar people from NY state from becoming affiliates. So now you have several thousands perhaps NYers who make income by being affiliates with no or reduced income thus they would be paying less or no state taxes. REAL fricken smart NY.

I wouldn't doubt my state try this. In my state I already get charged 9.75% sales taxes. They also charge 8.25% on FOOD. And they wonder why those that live near a border shop in other states. Heck I can drive 45 miles to the wal-mart in KY and buy $250 worth of groceries and despite gas being $3.25 a gallon I come out ahead because I pay no sales tax in KY on food.

If states would cuts the pork out of their budgets they wouldn't need more tax $$$

Not surprising NY did this since they tax just about everything they can think of with the exception of breathing. Amazon has 3 choices, stop affiliation, sue the state of NY or stop doing business in NY.

They are not doing business in NY - Only selling to people with NY mailing addresses. They have no PHYSICAL presence in NYS which is why they do not need to collect taxes on items shipped to NY addresses. It is the responsibility of the customer to pay "use taxes" if applicable. All this law is about is trying to do an end run around the lack of physical presence.
