A big win for Comcast and its subscribers in a federal court in Illinois.
Comcast successfully defended its subscribers from being harassed by so-called copyright trolls.
Plaintiffs should not be allowed to profit from unfair litigation tactics whereby they use the offices of the Court as an inexpensive means to gain Doe defendants personal information and coerce settlements from them, Comcasts lawyers wrote.
It is evident in these cases and the multitude of cases filed by plaintiffs and other pornographers represented by their counsel that plaintiffs have no interest in actually litigating their claims against the Doe defendants, but simply seek to use the Court and its subpoena powers to obtain sufficient information to shake down the Doe defendants.
Comcast cited several previous cases to back up their claims and pointed out that federal rules require courts to deny discovery to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense.
These arguments were successful because the judge quashed the subpoenas for the Comcast subscribers and dismissed the cases in question. | |

The school system in the Rochester suburb of Greece says it will suspend the middle school students from school and from using regular bus transportation for a year for bullying Karen Klein.
The students will be transferred to a special alternative education program because the district is legally required to give the students an education.
Each student will also be required to complete 50 hours of community service with senior citizens.
They will be able to reapply to middle school after their complete the discipline.
A fund drive that began in Canada with a goal of $5,000 to help Klein take a nice vacation raised more than $667,304 as of Friday.
Klein could not be reached for comment Friday. However, police have said Klein did not want the boys to face criminal charges.
In the AP interview last week, Klein asked people to leave the boys alone. "Threatening them? No. That's not the way to go about things," she said. "They're just kids."
"I don't want to judge anybody or put them in jail or anything like that. I just want them to learn a lesson."

Google Inc. says Chief Executive Larry Page has "lost his voice," but it won't say much more about the matter. Some corporate governance experts think the Internet company should speak up.
The billionaire co-founder missed Google's annual meeting Thursday, and the company said he will miss two other important engagements over the next several weeks.
The lack of details surrounding the matter prompted some speculation on Wall Street about whether he may have a serious medical condition.
At the meeting, Executive Chairman Eric Schmidt said Mr. Page had "lost his voice" and "can't do any public speaking engagements for the time being," including the coming week's Google annual conference for software developers and at the second-quarter earnings conference call that is expected in mid-July. He added that "Larry will continue to run the company, he's running all the strategic business decisions and all that."
Few watchers of the Internet giant seemed in a joking mood, however. That is especially true in Silicon Valley, where the death of Apple Inc. co-founder Steve Jobs is still fresh in people's minds.
Mr. Anmuth also noted that Mr. Page, who regularly posts links and comments on his Google+ social network account, hasn't posted anything publicly since May 25.
Mr. Page's voice generally sounds slightly strained, raspy or hoarse. A recording of a 20-minute speech last month in London showed Mr. Page noticeably pausing several times to swallow before continuing to speak, but it is unclear whether that was a symptom of his current problem.
Some leadership experts contend Google should divulge more about Mr. Page's voice problem. As the CEO of a public company, "he's not entitled to his privacy,'' said Jeffrey Sonnenfeld, a senior associate dean at Yale School of Management.
"We need to know if it [his voice] is imperiled," he said.
Google's conference for developers, called I/O, runs from June 27 to June 29. Its second-quarter earnings report and conference call haven't been scheduled; last year they occurred on the second Thursday of the month, an indication they could be held on July 19, or in nearly four weeks.

I have first hand knowledge of it. My father was diagnosed in 1992. They ended up doing a full laryngetomy on him. Brutal surgery. His cancer came back in 1998, and he was gone May of 1999. Mom passed December of next year of a different kind of cancer. Both were in their early 50's.
On a side note, when you're 27 and you bury your 50 year old parents a year and a half apart, you instantly become 40+ in your mind & life experience.

Any DSL is constrained by distance; live close enough to one of AT&T's nodes and 12mb/s, even 18mb/s are possible.
ADSL has been as reliable as cable, for me, albeit slower. But I have no desire to piss away ~$15 a month on "Limited Basic TV" just to qualify for $42.95 Internet.
But I pitched AT&T over caps, so why would I jump to a capped provider?
I see that "Xfinity" has a voice and Internet bundle for a promotional $39.99 fee (regular price $93.90). Contrast with my "Fusion" (Sonic.net, LLC) voice and Internet for $39.95 a month (not a promotional price). ADSL2+ at 9,156 feet from the DSLAM. Amazon Studios was calling for original comedy and childrens series projects, the company announced today that it has selected its first four projects, choosing three comedies and one childrens show.

I test drove their free program by diagramming most of my home network.

As you can see, I don't have much experience with drawing programs. That said, I felt it handled well enough. This diagram wasn't too painful to put together.

Today my mother declared my bedroom a disaster area. I would like to request federal funds to hire a crew to clean up my room. Reagan replied with the following letter.

Dear Andy:
I'm sorry to be so late in answering your letter but as you know I've been in China and found your letter here upon my return.
Your application for disaster relief has been duly noted but I must point out one technical problem: the authority declaring the disaster is supposed to make the request. In this case your mother.
However setting that aside I'll have to point out the larger problem of available funds. This has been a year of disasters, 539 hurricanes as of May 4th and several more since, numerous floods, forest fires, drought in Texas and a number of earthquakes. What I'm getting at is that funds are dangerously low.
May I make a suggestion? This administration, believing that government has done many things that could better be done by volunteers at the local level, has sponsored a Private Sector Initiative program, calling upon people to practice voluntarism in the solving of a number of local problems.
Your situation appears to be a natural. I'm sure your mother was fully justified in proclaiming your room a disaster. Therefore you are in an excellent position to launch another volunteer program to go along with the more than 3,000 already underway in our nationcongratulations.
