I read the linked article. He sent two emails, one requesting the upgrade date for his iPhone be moved up so he could upgrade sooner. The second complained about the new caps on service and indicated he was moving to Sprint.
After you indicate going to another company, it is very reasonable for a CEO (or his office) to tell you to stop writing. He essentially declared himself a non-customer, after being a pushy customer (two things no CEO needs to spend time on IMO).
On Sprint he can join the legions who keep trying to milk customer service for freebies. He'll feel right at home.
BTW: I'm a former AT&T customer, who didn't feel the need to write a letter or shoot an email prior to, during or after departure to the AT&T CEO. I also haven't asked Sprint for any freebies, just the discount I qualified for at the time. Personally I'm fed up by people who appear to have poor manners (such as Giorgio Galante from the linked story) who on alternating emails demand freebies, then threaten to depart. My hope is he isn't on Sprint too long, IMO nobody needs a customer like that. I guess somehow this is news.
In the meantime, Karl has missed a great story about the FTC wanting to expand copyright to protect "old" media. You see hyper text linking (the stuff the "web" is based on), results in people linking to stories published in the old media. The old media just doesn't like this web, but somehow demands to be on it, if only the government would fix it by taxing people who link or visit their stuff and give them better protection via new enhanced copyright. Story snip follows: Instead, the FTC staff declares defeat in the search for business models so it may explore many government interventions, including:
* Expanding copyright law and restricting the doctrine of fair comment to benefit legacy publishers.
* Granting antitrust exemptions to allow publishers to collude on pricing to consumers and to business partners.
* Giving news organizations tax exemptions.
* Subsidizing news organizations by increasing government funding to public broadcasting; establishing an AmeriCorps to pay reporters; giving news companies tax credits for employing journalists; creating a national fund for local news, and giving the press an increased postal subsidy.
To its credit, the FTC does ask how to pay for all this. So the staffers speculated about what I'll dub the iPad tax -- a 5 percent surcharge on consumer electronics to raise $4 billion for news. They also consider a tax on broadcast spectrum and even on advertising.
Most dangerous of all, the FTC considers a doctrine of "proprietary facts," as if anyone should gain the right to restrict the flow of information just as the information is opening it up. Copyright law protects the presentation of news but no one owns facts -- and if anyone did, you could be forbidden from sharing them. Then they usually just say oh give this person whatever they want just to make them go away. Which to me is only re enforcing bad behavior. Rarely has a CEO escalation been actually warranted. 99% of the time whatever angered the customer in the first place was the current policy(right or wrong) and should have been ad-heard to for this person as well. | |

But the thing that strikes me about this is that any fool can write a letter threatening anything they want, but unless there is either legislation or a court order backing it up, it would seem to me that their threats ought to be meaningless. If that were not the case, we'd have a nation of lawyers (and even regular people) getting rich by simply writing cease and desist letters. For example, you could write a cease-and-desist letter to ever major bank and credit card company, and the next time they send you one of those pre-approved credit card offers, haul them into court for violating your cease-and-desist (I'm NOT seriously suggesting anyone try this, just trying to illustrate the absurdity of attaching too much importance to such a letter).
Just because AT&T's CEO may think he's important s...tuff does not mean he has an absolute right not to be contacted by customers, dissatisfied or otherwise. If they are calling him at 2 A.M., that would probably constitute harassment and would violate some law. If (just as a hypothetical example) it were someone calling to collect a debt and he told them not to call him again, that would probably violate the FDCPA (a specific piece of legislation that covers debt collection practices). But I don't see how a simple occasional e-mail, unless it contained specific threats or something else that is actionable, or violates a specific piece of legislation such as the FDCPA, would be in violation of any law.
Now granted, in the United States we have the one of the screwiest legal systems in the world, so nothing is a given - maybe if the OP ignored the cease-and-desist, he might become one of those outrageous "edge cases" that makes the news. But otherwise, I don't understand how sending a simple letter, no matter what sort of legal language it may contain, can place any obligation on the recipient to do what the letter instructs (or not do, in this case). Otherwise I think a lot of folks could get very rich just by writing letters in their spare time.
If any attorneys are reading this and can enlighten us on this, I for one would love to hear the explanation of how these letters work - or don't. | |
