As we noted earlier this month, a new company by the name of Zer01 has been getting a lot of attention for their promise of unlimited voice and data on smart phones for $69.95/month. There's quite a few (huge) catches, including the fact that the voice component is really VoIP with Zer01 operating as a mobile virtual network enabler (MVNE) -- who delivers service and phones to mobile virtual network operators (MVNO). Of course when the service "launched" on July 1, it was interesting to see the company hadn't signed up a single MVNO partner.

We’re pretty much completely helpless from our standpoint.
-Zer01's CEO Ben Piilani, on the ludicrous marketing claims circulating about the company's product.
This week finds Nancy Gohring at Computerworld pens a piece that notes how Zer01 has all the tell-tale signs of an MLM and pyramid scheme, with no substantive product to speak of, vague and inconsistent technical specifics, all operated by a MLM marketing man named Mark Petschel -- currently on probation after pleading guilty to securities fraud. Gohrig notes that the parent company of Zer01, UTG, also gives off a rather fishy smell:
For instance, UTG lists its head office under "Illinois offices," but provides an address for that headquarters in Creve Coeur, without noting the state. Creve Coeur is a suburb of St. Louis, Missouri. The leasing agent for that office building has no record of UTG at the location. A group that rents space in the building to small businesses said that UTG may have used space there in the past, but doesn’t currently.
Gohring gets attacked in the Computerworld comment section for not giving the company a chance, several angry posters insisting that many legitimate companies originate with floating headquarters, limited product, and executives with suspect histories. But Derek Kerton, who interviewed Zer01 management recently at CTIA, also has his doubts after seeing a product that technically was little more than shiny GUI.
I've seen all forms of wacky claims made by Zer01 re-sellers while researching this post. I've read how it roams from AT&T, to T-Mobile, to Rogers, to TELUS (with no mention of the fact that TELUS uses CDMA networks not supported by the phones they offer). I've read that it will work in airplanes, that "it's got the 2100MHz speed," that you can download a movie to your laptop in 3 minutes, that it includes SMS MasterCard mobile payment, and that it uses "the proprietary patented technology that Zer01 has that allows your phone to switch from GSM, Tri-Band, Quad-Band, Wi-Fi to connect to the VoIP," that it's 4G, that it's 5G and that it offers 20Gbps on a private FTC-licensed 2100MHz network. The claims range from the improbable to the technologically incoherent or both.

But Laptop Magazine, who praised Zer01 at CTIA, gives Zer01's CEO Ben Piilani a chance to defend himself. According to Piilani, when he found out about Petschel's securities fraud conviction, he managed to get him to step down as Global Verge CEO. He insists usable product will be in journalist hands "within weeks," and blames MLM partners for essentially everything that's gone wrong:
What happened was [[Buzzirk’s]] base grew too fast I guess and they didn’t have their compliance in place and so their agents… it’s one of those things you tell one person and by the time it gets down the chain it’s a totally different story. And they just started marketing that stuff. So according to our agreement they weren’t allowed to put out any public materials without passing it through us first.
Right after blaming his MLM partners, Piilani says he'll keep right on doing business with them. The evidence so far suggests that Zer01 is little more than MLM vaporware being lorded over by MLM outfits Buzzirk and Global Verge, netting a few ambitious but amoral gentlemen a nice payday before the operation flames out spectacularly or whimpers through a largely irrelevant lifecyle. If Zer01 is legitimate, they're going to need substantially more than shiny baubles and a non-existent product to do battle with the AT&T and Verizons of the telecom universe.

When this 1st appeared 3 weeks ago, even then it was pretty obvious that this was one of those vaporware schemes meant to part people from their money. There are so many better ways to get wireless service than thru these guys. Part of the problem is that when one of these so-called startups issues a press release then all the tech blogs start flogging their product. But very few of them ever do real journalistic work anymore and check out if it is legit or not.

It's Ben Kingsley. Funny how the photo in the background is a Nokia phone, but Zer01 (Buzzirk) says they use WinMo phones. I suppose they had to put REAL a phone in the grab, so just used Nokias without any Zer01 services on them.

Zer01, in their quest to appear legit, has started a decent facade:

- got included in a grab bag at a Hollywood event.
- won Laptop Mag's "Best In Show" at CTIA (Dumb reporters must have just taken every claim at face value.
- Piilani got a speaking slot at CTIA, CES, and Mobilebeat, all respected industry events

His claims, if given the benefit of the doubt, would look very disruptive, and thus interesting to a conference organizer. No wonder he was given a panel slot. These rooms have about 100 in the audience.

All the speaking gigs were this year. Of course, they are using three speaking slots as a panelist to literally claim that Piilani is "in extremely high demand as an expert speaker", and respected in the industry.

I've chaired and moderated panels at CTIA over half a dozen times over 6 years, and speak publicly about 40 times a year. I would just consider myself a "moderately" in demand expert speaker.

Piilani also paid a money for a Republican fundraiser that got him handshake photos with Dick Cheney, and a meaningless but nice sounding "congressional" award from the RNC. When the RNC saw that he was advertising it as an award received for merit (not money) they asked him to stop. Actually, this is a kinda shady practice of both political parties, as much as Piilani.

This looks more like a human example of a "pump and dump" scheme. Pump up CEO Piilani and Zer01 to look good so they can pull off the grift.

Who cares?

Granted, it's not a smartpone, but you can get nationwide unlimited now for $45 per month through StraightTalk. Or $60 per month + data from Virgin Mobile. Or if you want data, Sprint's Simply Everything plan is $100. Boost Mobile is $50. All of which use the cellular network for calling, rather than taking a voice network, kludging data onto it, then trying to use that kludged, jitter-ridden data service (EDGE, GRPS, UMTS to some extent) to place and receive calls.

At the beginning of Zer01's existence, their product seemed a bit of a stretch but something that looked halfway legit: $70-a-month data service, with VoIP running over that data on Windows Mobile phones to give unlimited calling. Now however that simplicity is clouded with so much crap that people (rightfully) don't think the biz is legit.

I heard that you can hook their smartphones into your car's radio, and that the phones will use GPS capabilities to automatically drive your car for you to your desired destination.

And the RF emitted from their smartphones also retards hair loss, so the more you talk on them the less bald you become.

Still trying to figure out how to work in some smart-*ss "virtual Viagara" quip.

I was actually talking to them and yes there is a fee to become a re-seller or even a "Rep" for them. I believe it was 149.99. It sounded a little off, because the woman whom I had contact with said for every service I sold, I would get like &5 or &10/month off my cell phone bill with them, and when I had enough customers, I would start making money. I was like, Ok, bye bye

There is indeed a Creve Coeur in Illinois. It is right next to East Peoria in between Bartonville and Marquette Heights. It's not a very big place how ever. I think their population is only around 6000. Let me guess, the only Bloomington in the US is in Indiana right?

I'm not on Ze01's side in the least bit here. I'm just saying. if you use a location fact as one of your main selling points of a potential "scam" at least break out the Google Maps or something.

I have no idea where they are. I wasn't commenting on the company themselves, rather the fact that the article states that Creve Couer was in Missouri and not Illinois. I haven't visited their site nor do I have any intentions of doing so.

His conviction raises some serious questions, but Vonage's original founder (Jeff Citron) had a securities fraud conviction and I don't think anyone would call Vonage a fraud.

I see plenty of differences and I am skeptical of this venture. I simply was pointing out that the conviction should not be proof positive.

Vonage is shipping a working product. Some people don't love it; others think it is great, but I think people generally agree that Vonage is a legitimate business. No one has seen a working phone with zer01 and that is troubling. Do they even have an MVNO agreement?

Currently, we have in the field about 10 working phones

Currently, we have in the field about 10 working phones in our network using Zer01 and their awesome technology. These have been functioning for some time. We know the technology works.

On Monday of this week we received two more updated SIM chips. They also work on Zer01's system and have been used the past four days. In the next few days we will have SIMs that will boot up showing the Buzzirk Mobile logo, and a several of these will be given out. At that point we can begin to tout the phones publicly--show them off to the world.

After that, a larger rollout is planned. Firm dates cannot be given or quantities until next week. Please understand that we are not the carrier and we do not produce the SIM cards and we do not control date of availability, we can only tell you what we are told. You will see announcements made next week explaining firm dates from the carrier.

These jokers officially launched on 1st July, yet are still claiming to be writing and/or testing SIM software?

Most SIM card manufacturers have order lead-times of a few weeks

... so even if this is completely genuine it could hardly get to the market in less than a couple of months from now, not the 8 days mentioned somewhere

I looked at there coverage map on the home and compared it to Verizon's coverage. There both the. Does this mean that Verizon will be offering the service on it's network?
