Make sure your selecting the correct serial port and that its secured good. Also make sure your serial ports are enabled in your bios. Some manufacturers disable them to free up resources for faster boot times. Also a factory reset is usually a good idea. I am certain I have the serial port installed and working properly, hyperterminal would tell me it cannot open com1 if it weren't available and configured. I am actually getting notification that it is connecting, however, I never get a prompt. I didn't know about needing to inform the provider, I will give that a try.
I was thinking that I should be able to access the modem/router through the console port without having an internet connection. Is that not true?

You should be able to access the router's console port without an internet connection.

Now, make sure that it is NOT connected to your ISP's network because if you leave it connected, the config file downloaded from the CMTS will lock you out to prevent any tampering with the ISP's config.

Once your CM is not hooked up, on the back you should spot a reset button... hold that down for approximately 3-5 seconds. Then shut off the router for over 30 seconds. That should get rid of the ISP's config file, then put it back on still leaving it unplugged from the internet and see if you can access it now via console.
