It was the creditors and was based on the Supreme court decision against Arthur Anderson LLC, which was overturned (in that case), but not applicable to this one; 'http://www.post-gazette.com/pg/05165/521124.stm Here's a piece out of the article:
U.S. Bankruptcy Judge Robert Gerber on May 20 approved a settlement of the SEC suit in which the Justice Department agreed not to bring charges against Adelphia. Several creditors asked him to reconsider, arguing a Supreme Court decision overturning the conviction of Arthur Andersen LLP in another case showed the government couldn't indict Adelphia, making the pact pointless.
