Re: Website Trademarking

In which fields of business is your claimed trademark name used? You realise that a trademark is only valid in certain fields, generally, and that hundreds of companies can have the same trademark if they are trading in different fields?

The other site may be seeking information on the fields in which you have a trademark or potential trademark to determine whether there is a potential trademark conflict between you and them.

The simple phrase "assassin 4 hire" seems like one which could be quite hard to obtain a trademark for, since it's a fairly well known phrase.

In theory that is true, but in the real world not so. Try and register a trademark with the name of Microsoft Eye Care and see what happens. Even though Microsoft is not in the eye care field, they will sue and win.

That's because "Microsoft" is a famous trademark. There are different rules for them.

However, "Kodak" is also a famous trademark, but we have a "W. Kodak Jewelers" in New Jersey. It might be that the family's last name is Kodak, so the camera/film company can't keep them from using the name.

The questioner has no registered trademark, let alone the famous trademark required for that level of coverage. And even for famous trademarks, prior trademarks, registered or not, are recognised, though it often takes a fight to keep them.
