No, Aereo is giving them access to the SAME airwaves that they should already be able to receive, but cannot due to issues out of their control... structural/other blockages/inability to put up a proper antenna/whatever.

It's not like Aereo is selling NYC locals to people in Pittsburgh.

And that's different from traditional cable... how? That's EXACTLY what your cable company is doing! And yet they're obligated to pay for the retransmission.
