ATT Uverse trenched right through the middle of my front yarI am not even an ATT customer, this is not anywhere near an easement. what recourse if any do I have? |

New neighborhood? If construction is still going on, I would ask the builder what the situation is. I suspect you may not have actually checked whether there is an easement. |

I've lived here for 6 years, although the home next to me is new.
I have my plot in front of me, the ONLY utility easement is 20' in my back yard. |

It doesn't matter if the neighborhood is still being built up? They can only trench through their easements, and even THEN they are required to repair any surface damage they cause. |

Maybe because some of us spend THOUSANDS of dollars on our lawns? My lawn is an asset of my home, if I tried to sell my house right now the value would be significantly compromised because of this. |

Wow, you really need to take it easy a bit. Honestly, I'd just take note of where the line is for future reference and live with it. What do you want them to do? I bet you will find that there is a easement along the roadway. Every roadway has one and many of them are huge! In many states there are laws that automatically define the size of such easements telepathically cannot actually show up on your plot plan. AT&T and every other major utility checks before they installed lines to ensure they are in appropriate areas and I'm sure this is no different. |

I think you are presuming you would do a lot of watering in SJ. Because if you did not water, you would probably not have green grass in the summer. Maybe reikl depends mainly on rain. Maybe he is thinking that the utility should be doing the watering to restore the landscaping. Perhaps a phone call to the utility or the town would get it some attention. The town probably has strong influence. It sure looks like that strip has been suffering from lack of water. |

A) This is no where near the road it is in the middle of my front lawn, a good 20' from the road.
B) Dead grass does not just 'grow back' the section is going to have to be cut out and re sod'd. My guesstimate is about $500 in cost to me to repair the damage. |

If a teenager came through and broke all my windows with a baseball bat, would you say 'well what if a hailstorm came through and broke all your windows?' thats an absurd response.
I realize many of you don't place the same value on your lawns, in my neighborhood however lawn care is a major ordeal and we spend a lot of money on our lawns. This is a large eye sore that is not going to just go away in a few weeks it is going to take a minimum of 1 year to repair this damage. |

I'd be torqued too - especially if I lived in one of those HOA communities. The HOA police will demand the homeowner "fix" the issue - not AT&T.
Easements are designed to allow the utilities access for their services. They don't have the right to just run it where ever it convenient. They should have followed the easement or contacted you.
I'd consider getting an attorney, and drafting a letter to AT&T demanding they move the line to the easement. |

I think it is too late to do anything about the line itself. Having them move the line would just increase the amount of damage done to the lawn. Only thing that can really be done now is damage control. |

Two more months and it will be all covered by leaves or snow. Just put some seed down and chill out. There are more problems around than to get your blood pressure up. You'll end up with a heart attack and that grass thing won't matter. |

On the other hand, there may have been some form of permission. I think that we agree that some form of permission should have existed before trenching. If there is actually an association, maybe they are empowered to provide the permissions. Maybe it is the city. I just don't know. I just think it would be more efficient to ask the builder or the association. Maybe there was an easement that was not entered on the survey. Maybe his title insurance would pay him for the loss. Maybe he wants his neighbor's internet cut. It's hard to know. We do know that he could minimize damage by watering the swath, and then trying to collect compensation that included that mitigation. It does serve to remind people to call JULIE, or whatever it is called in his area, before doing certain digging after they buy a used house. |

I highly doubt that is a trunk burial. Most likely one of your neighbors had new service installed and they had to install the feeder cable from their NID to the pedestal. That is par for the course for that type of install. Since they had to trench across your yard to get to the pedestal, you would think they would at least have the courtesy to let you know. But they are contractors and don't care.
I had mine installed initially when I moved in last September and then they just had to replace it and bury a second cable exactly 2 months ago, due to line issues. Granted it is a little frustrating to see your yard torn up again, after we had just had a pool put in and they had to install the backwash drain pipe to the main sewer line running under our front beds. But, to be honest, I can't even tell where they buried the cable just 8 weeks later. The yard looks immaculate.
Just breathe and unbunch your panties. It is not as bad as you are making it out to be. Were you listing your house in the next 6 to 8 weeks? |
