Because a cable company refuses to activate cable modem really only means that the unit is / was associated with an account on the same system. If an item is actually "stolen", there should be a police report somewhere to prove it was reported as stolen.
The fact is that Comcast is semi-notorious for claiming ownership of customer owned equipment and suddenly starting to charge rental fees for this customer owned devices. These instances have been repeatedly reported.
There is about a 90%+ chance that if you upgrade your currently owned cable modem and then sell or give that old unit to a friend or family member on Comcast, they will be told that it cannot be activated and either imply or actually state that the item is "stolen". There are even reports on this forum from folks who moved from one Comcast location to another and find they have the same kind of problem.
