Re: [Serious] Vaccine Passports now in effect in Ontario

said by taraf:

Incidentally, the Ontario Human Rights Commission would agree with that sentiment, as they issued a policy docket last week which states that regardless of whether it's because of a "sincerely held religious belief" or however else you want to couch it, deciding not to get vaccinated is not protected by the human rights laws in this country.

I'm not aware that BC (where I live) has done anything like this, I'm sure it would've been on the news if they had. So I guess by the country you mean the province of Ontario?

(It would be nice if BC did though...)

I believe the presumption is, if OHRC has made this determination and said "sorry... refusing vaccination is NOT covered by the human rights commission" they are applying with consistency the rules they must follow under the Canada Human Rights Code - and are not at opposition to it (their council would have ensured that). So - while other provinces may have not made that determination yet, it would appear at a nationwide level there's nothing there, and as far as ON is concerned there's nothing there either.

General rule of thumb when it comes to this kind of question is that if there's no ruling in your own province, look at what's been determined in others as a guideline. If it even comes up, you can guarantee that the BC Human Rights Commission will be looking at what Ontario & Quebec have said when making their own ruling.

So yeah, I'm not aware of any similar policy in BC, but it would surprise me if BC didn't fall the same way when/if it comes up.

I "asked Mr. Google" and got a bunch of hits. Unfortunately the BC Human Rights Tribunal web site vaccine links seem to be down, so I'll link to a CBC interview with Emily Ohler, the chair of the tribunal. »www.cbc.ca/news/canada/b ··· .6188593

Ohler said the public needs to understand that the tribunal's powers are strictly defined, and they only involve resolving alleged violations of the B.C. Human Rights Code.

"The code does not protect personal choice or personal preference. The code protects personal characteristics like disabilities or sex or race or gender identity," Ohler said.

"We cannot help people who think their charter rights are being violated. We cannot help people who don't like the government's approach to the pandemic."

So if you choose not to vaccinate/mask "just because", it's your problem. Oh, and »www.cbc.ca/news/canada/b ··· .5972326

Human rights tribunal puts anti-maskers on notice, saying complaints require proof of disability

Unfortunately the media around here focus on the antivax morons, give them all sorts of headlines. Not once have they mentioned this (well, to my knowledge anyway. I do try to keep up with news.)
