Copyright law applies to people making money off of a copyright without paying. There is a section that mentions mass distribution, but that would only apply to the super node users (who I think are abusing any credence to file sharing has anyway). So in effect the casual user who downloads a few songs a week and shares the same is not even punishable by current copyright law.

Have you ever wondered why the RIAA hasn't gone after any of the individuals they know have traded files? Why do they keep talking about everybody being pirates but no direct action has been taken? Why is the RIAA only going after organizations like Kazaa, universities and now ISP's? I bet the reason is because there is no valid case against it.

No, I haven't wondered why the RIAA doesn't go after individuals as opposed to larger groups. It's obvious they they would go after something (mass distribution) that has a better cost/benefit ratio than something (casual users) that doesn't.

The point I originally made was of the flawed logic in the desire to charge ISPs for traffic they don't currently have control over and shouldn't have to monitor in the first place.
